COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 040032, AS
AMENDED
Approving the 2004-2008
Consolidated Plan and 2004 Housing and Community Development Action Plan,
authorizing the Mayor to execute and submit the Plan to the United States
Department of Housing and Urban Development; and certifying that the Action
Plan has been prepared and submitted in accordance with the Departments rules
and regulations.
WHEREAS, Congress
and the President signed the Cranston-Gonzalez National Affordable Act on
November 28, 1990; and
WHEREAS, Title I
requires cities to submit to the United States Department of Housing and Urban
Development a document which consolidates the previous Comprehensive Housing Affordability
Strategy (CHAS) and four federal entitlement programs into a single 5-year
document entitled the Consolidated Plan; and
WHEREAS, Title I
requires cities to submit a 5-year Consolidated Plan inclusive of a 1-year
Action Plan, and any amendments to the 5-year Plan on an annual basis; and
WHEREAS, Title I
authorizes the Secretary of the U. S. Department of Housing and Urban
Development to award grants to units of local government, such as the City of
Kansas City, Missouri, to finance its Community Development and Housing
Programs; and
WHEREAS, the four
grant programs included within the 2004 Consolidated Action Plan are the
Community Development Block Grant Program, the HOME Investment Partnership Act
Program, the Emergency Shelter Grant Program, and the Housing Opportunities for
Persons with Aids Program; and
WHEREAS, for
2004, the City of Kansas City Missouri, intends to submit a full 5-Year
Consolidated Plan, inclusive of a 1-Year Action Plan showing housing and
community development activities, performance goals, and funding amounts from
each grant source, in application to the four programs pursuant to and in
accordance with Title I of the National Affordable Housing Act of 1990, as
amended, and appropriate administrative rules and regulations promulgated and
adopted under such Act; and
WHEREAS, the
2004-2008 Consolidated Plan includes housing and community development
strategies for the 5-year period, which were developed from the following
resources: the adopted City Housing Policy Goals, the 2000 Census, the
completed Housing Conditions Survey, and FOCUS Assessments for each strategy
area as determined by resident input; and
WHEREAS, the
Council has made significant changes to the 2004 Action Plan presented to it
for consideration by City staff; and
WHEREAS, after
the Neighborhood Development and Housing Committee voted on the Committee
Substitute it was learned that the funds budgeted for Barrier Removal were
$70,000.00 higher than the Committee desired; so, this amendment reduces both
the estimated program income
and the funds budgeted for
Barrier Removal by $70,000.00; and
WHEREAS, after
the Neighborhood Development and Housing Committee voted on the Committee
Substitute, a need for $250,000.00 of funding for the Economic Development
Corporation was identified, along with a need for $50,000.00 of additional
funding for the East Meyer Area. The amendment adds these amounts to Year 1
(2004-05) of the Consolidated Action Plan and reduces the funding for the
following activities in Year 1 by the following amounts: 12th Street Model
Block ($100,000.00), Montgall Model Block ($100,000.00), Mooneys Villa
($25,000.00), North Oak Corridor ($25,000.00), Bannister Acres and Citywide
Sanitary Sewer ($50,000.00), HEDFC Administration ($50,000.00), and increases
in Year 1 of the Consolidated Plan the funding for the following activity by
the following amount: Swope Community Builders ($50,000.00) and increases the
funding in Year 2 of the Consolidated Plan for the following activities by the
following amounts: 12th Street Model Block ($100,000.00), Montgall Model Block
($100,000.00) and Sanitary Sewer Program ($100,000.00); NOW, THEREFORE,
BE IT RESOLVED BY
THE COUNCIL OF KANSAS CITY:
Section A. That
the 2004-2008 Consolidated Plan and 2004 Housing and Community Development
Action Plan prepared pursuant to the National Affordable Housing Act of 1990,
as amended, a copy of which in substantial form, is attached hereto and is
hereby approved.
Section B. That
the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized
to execute and submit the aforesaid Plan to the United States Department of
Housing and Urban Development.
Section C. That
the City Council hereby certifies that said Action Plan has been prepared and
submitted to the U.S. Department of Housing and Urban Development pursuant to
and in accordance with the Departments rules and regulations, including but
not limited to Title 24, Part 91, and Sections 570.302 through 570.304 of the Code of Federal Regulations.
