Approving
a Community Unit Project on an approximately 5.76 acre tract of land generally located
on the north side of N.W. 72nd Street, approximately 370 feet west of N.
Broadway Avenue and west of the Gladstone corporate limits. (8483-CUP-7)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a Community Unit Project on an approximately 5.76 acre tract of land
generally located on the north side of N.W. 72nd Street, approximately 370 feet
west of N. Broadway Avenue and west of the Gladstone corporate limits, and more
specifically described as follows:
A tract of land located in the Southeast Quarter
of Section 15, Township 51 North, Range 33 West, Kansas City, Clay County,
Missouri, being more particularly described as follows: Commencing at the
southeast corner of said Southeast Quarter; thence North 89E32'53" West along the south line of
said Southeast Quarter, a distance of 399.62 feet; thence North 00E27'07" East, a distance of 35.00
feet to the north right of way line of N.W. 72nd Street and the point of
beginning of the tract of land to be described; thence North 89E32'53" West along said north right
of way line, a distance of 296.02 feet; thence South 00E19'39" West, a distance of 60.00
feet to the north line of Lot 1, North Park Place, according to the recorded
plat thereof; thence North 89E32'53"
West along said north line of Lot 1, a distance of 263.79 feet to a point on
the east right of way line of U.S. Highway 169; thence North 01E01'59" East along said east right of
way line, a distance of 23.36 feet; thence North 03E45'39" West continuing along said
east right of way line, a distance of 348.46 feet; thence North 00E58'57" East continuing along said
east line, a distance of 256.35 feet to the south line of Willow Creek,
according to the recorded plat thereof; thence South 34E15'00" East along said south line, a
distance of 223.45 feet; thence North 90E00'00"
East continuing along said south line, a distance of 380.00 feet; thence South
81E25'23" East
continuing along said south line, a distance of 99.40 feet; thence South 00E17'03" West parallel to the east
line of said Southeast Quarter, a distance of 82.06 feet; thence North 89E32'53" West parallel with the south
line of said Southeast Quarter, a distance of 23.69 feet; thence South 00E17'03" West parallel to the east
line of said Southeast Quarter, a distance of 290.40 feet to the point of
beginning. Contains 250,776 square feet or 5.76 acres, more or less.

hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval when the first final plat is submitted and
that the developer construct any improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer dedicate additional right of way for N.W. 72nd Street as required
by the Department of Public Works so as to provide a total of 30 feet of right
of way as measured from the centerline of N.W. 72nd Street and to provide 100
feet of right of way for the permanent cul-de-sac as shown on the Community
Unit Project Plan.
7. That
the developer construct the north side of N.W. 72nd Street to collector street
standards as required by the Department of Public Works, including construction
of curbs, gutters and sidewalks and installation of streetlights.
8. That
the developer remove the existing temporary cul-de-sac on N.W. 72nd Street and
construct a permanent cul-de-sac at the location of the existing temporary
cul-de-sac, as shown on the Community Unit Project Plan as required by the
Department of Public Works.
9. That
the developer construct all private drives to City residential street standards
as required by the Department of Public Works.
10. That
the developer submit a street name signage plan for the entire development to
the Street Naming Committee for approval prior to submittal of a final plat.
11. That
the developer secure the approval of the Missouri Department of Transportation
prior to working within any State right of way.
12. That
the developer extend and relocate sanitary sewers as required by the Department
of Public Works.
13. That
the developer extend and relocate water mains and provide easements as required
by the Water Services Department.
14. That
the developer install hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
15. That the
developer contribute $4,922.16 in lieu of parkland dedication in satisfaction
of Section 66-128 of the Subdivision Regulations.
16. That
the developer submit a final plan to the City Plan Commission for approval
including detailed information on grading, landscaping, signage (including elevations)
and building elevations.
A
copy of said Community Unit Project plan is on file in the office of the City
Clerk under Document No. 020195, which is attached hereto and made a part
hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed Community Unit Project hereinabove, all public notices and hearings
required by the Zoning Ordinance have been given and had.
