Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0361,
rezoning an area of approximately 14.8 acres generally located on the north
side of N.W. 68th Street and south of N.W. 70th Street, approximately 165 feet
east of N. Mercier Street and approximately 130 feet west of N. Madison Street,
from District RA (Agricultural) to District R-1a (One-Family Dwellings).

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0361, rezoning an area of
approximately 14.8 acres generally located on the north side of N.W. 68th
Street and south of N.W. 70th Street, approximately 165 feet east of N. Mercier
Street and approximately 130 feet west of N. Madison Street, from District RA
(Agricultural) to District R-1a (One-Family Dwellings), said section to read as
follows:

80-11A0361. That an area legally described as:
TRACT 1: The south 581.40 feet of the East Half
of Lot 9, Eureka Farms, a subdivision in Kansas City, Clay County, Missouri,
described as follows: Beginning at the southeast corner of the Northwest
Quarter, Section 22, Township 51, Range 33; thence North 90E00' West along the south line of said
Northwest Quarter for 165.57 feet to the west line of the East Half of Lot 9;
thence North 0E12'39" East along
said west line for 581.40 feet; thence North 90E00' East for 165.62 feet to the east line of Lot
9; thence South 0E12'57" West along
said east line for 581.40 feet to the point of beginning. Containing 2.21
acres, more or less.
TRACT 2: A portion of the South Half of Section
22, Township 51, Range 33, Kansas City, Clay County, Missouri, described as
follows: Commencing at the southeast corner of the Northwest Quarter, Section
22; thence North 0E12'57" East along
the east line of said Northwest Quarter and the east line of Lot 9, Eureka
Farms, a subdivision of record for 581.40 feet for the point of beginning;
thence North 90E00' West for 165.62 feet
to the west line of the East Half of Lot 9; thence North 0E12'39" East along said west line for
746.17 feet to the north line of Lot 9; thence South 89E50'33" East along the north line of
Lot 9 for 165.68 feet to the northeast corner of Lot 9; thence South 0E12'57" West along the east line of
Lot 9 for 60.00 feet; thence South 89E45'31"
East for 329.46 feet to the east line of Lot 5, Eureka Farms; thence North 0E13'33" East for 60.00 feet to the
northeast corner of Lot 5; thence South 89E45'31"
East along the north line of Buena Vista, a subdivision of record for 269.47
feet; thence North 0E14'08" East,
parallel to and 60.00 feet west of the east line of Hidden Lakes Tract C, a
subdivision of record, for 142.99 feet to the south right of way line of N.W.
70th Street (50 feet right of way); thence southeasterly along said right of
way being a curve to the left, radius 334.72 feet, tangent bearing South 62E00'16" East, central angle 11E06'38", for 64.91 feet to the
northeast
corner of Tract C; thence South 0E14'08" West
along the east line of Tract C and the east line of Buena Vista, for 781.00
feet to the southeast corner of Buena Vista; thence North 89E51'02" West along the south line of Buena Vista and the south line
of the North Half of Lot 5, Eureka Farms, for 658.71 feet to the east line of
Lot 9; thence South 0E12'57" West for 82.16 feet to the point of
beginning. Containing 12.589 acres, more or less.

hereby rezoned from District RA (Agricultural) to District R-1a (One-Family
Dwellings), all as shown outlined on a map marked Section 80-11A0361, which is
attached hereto and made a part hereof, and which is hereby adopted as a part
of an amendment to the zoning maps constituting a part of said chapter and as
an amendment to Section 80-11 thereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
