ORDINANCE NO. 101010
Rezoning an area of approximately
6.07 acres generally located on the west side of Phelps Road, approximately 425
feet south of E. 49th Street, from District RA to District R-1a. (14007-P)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning and Development Code, is hereby amended by enacting a new
section to be known as Section 88-11A0878, rezoning an area of approximately
6.07 acres generally located on the west side of Phelps Road, approximately 425
feet south of E. 49th Street, from District RA (Agricultural) to District R-1a
(One-Family Dwellings, Medium Density), said section to read as follows:
Section 88-11A0878. That an area legally described as:
TRACT
I: The South 1/2 of that part of the North 1/2 of the Southeast 1/4 of the
Southwest 1/4 of Section 25, Township 49, Range 32, described as follows,
to-wit: Beginning at a point, which is 73.6 feet South of the Northwest corner
of the Southeast 1/4 of the Southwest 1/4 of said Section 25, and running
thence East 740.6 feet to the center line of Phelps Road (said Phelps Road
being one and the same as “the County Road”, referred to in deed from William
Cruwell to Andrew Cruwell and Eliza Cruwell, his wife, filed November 17, 1922,
and recorded in Book 358 at page 531); and running thence South along the
center line of said road 589.4 feet, more or less, to the South line of the
said North 1/2 of said 1/4 1/4 section; thence West along along the South line
of said North 1/2 of said 1/4 1/4 Section 737.5 feet, more or less, to the
Southwest corner of said North 1/2 of the Southeast 1/4 of the Southwest 1/4,
and running thence North 589.4 feet to the point of beginning, except that part
thereof now in the County road, and Except the South 12 feet, all situated in
Jackson County, Missouri.
TRACT
II: Beginning at the Northwest corner of Lot 1, Cruwell Addition, Jackson
County, Missouri; thence East along the North line of said lot 455.67 feet, to
a point 258.96 feet West of the Northeast corner of said lot; thence Southerly
100.2 feet to a point on the South line of said lot, said point being 253.20
feet West of the Southeast corner of said lot; thence West 460.91 feet to
Southwest corner of said lot; thence North 100 feet to the point of beginning.
TRACT
III: A strip of land twelve (12) feet in width and extending west from Phelps
road a distance of 719.05 feet and further described as follows, to-wit; thence
South twelve feet (12') of the North half of the following described tract: Beginning
73.6 feet South of the Northwest corner of the Southeast Quarter of the
Southwest Quarter of Section 25, Township 49, Range 32; thence East 740.6 feet
to the center line of Phelps Road, thence South along the center line of said
road 589.4 feet; thence West 737.5 feet to the West line of the Southeast
Quarter of the Southwest Quarter of said Section 25; thence North 589.4 feet to
Beginning, excepting only that part in the public road, said strip lying
adjacent to and North of the South half of the tract described. Containing
6.07 Acres, more or less.
is hereby rezoned from District
RA (Agricultural) to District R-1a (One-Family Dwellings, Medium Density), all
as shown outlined on a map marked Section 88-11A0878, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
