Approving the preliminary plat of Barry Woods on a 12.3
acre tract of land generally located on the west side of N. Baughman Road at
N.W. 79th Street Terrace.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That the preliminary plat of Barry Woods
on a 12.3 acre tract of land generally located on the west side of N. Baughman
Road at N.W. 79th Street Terrace, and more specifically described as follows:
A tract of land being part of the Fractional
Northwest Quarter of Section 15, Township 51, Range 33, Kansas City,
Platte County, Missouri, being bounded and described as follows: Beginning
at the northeast corner of said Fractional Northwest Quarter (Platte
County); thence South 89 21'59" West, along the north line of said
Fractional Northwest Quarter, 776.76 feet to the west line of said
Fractional Northwest Quarter; thence South 00 16'51" West, along said
west line, 695.90 feet; thence North 89 21'59" East and parallel to
said north line, 436.00 feet; thence North 85 10'00" East, 341.33
feet to the east line of the Fractional Northwest Quarter of Section 15,
Township 51, Range 33 (Platte County); thence North 00 20'38" East,
along said east line, 670.92 feet to the point of beginning. Containing 12.30
acres, more or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development and that improvements be made as
required by the City Engineer's Office.
3. That the developer obtain a land disturbance
permit from the Department of Natural Resources if the disturbed area
for the entire development exceeds five acres.
4. That the developer dedicate an additional 40
feet of right of way as measured from the centerline of N. Baughman
Road.
5. That the developer improve one-half of N.
Baughman Road to arterial street standards.
6. That the developer construct an on-site
temporary cul-de sac at the west end of N.W. 79th Street Terrace.
7. That the developer submit a street name sign
plan for the entire preliminary plat area for approval by the Street
Naming Committee prior to submittal of the first final plat.
8. That the developer construct sidewalks on the
west side of N. Baughman Road.
9. That the developer submit a street tree
planting plan for approval by the City Forester.
10. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
11. That the developer extend water mains as
required by the Water Services Department
12. That the developer provide fire protection as
required by the Fire Department.
13. That the developer contribute $7,254.99 in lieu
of parkland dedication for 39 single family lots in satisfaction of
Section 66-128 of the Subdivision Regulations.
14. That the developer submit covenants and
restrictions for maintenance of Tract A.
A copy of said preliminary plat is on file in the office
of the City Clerk under Document No. 960183, which is attached hereto and made
a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed preliminary plat hereinabove, all
public notices and hearings required by the Subdivision Regulations have been
given and had.
