ORDINANCE NO. 950368

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2581, rezoning an area of approximately 1.26 acres generally located north of 107th Street on the west side of Blue Ridge Boulevard (10604 and 10610 Blue Ridge Boulevard) from District C-1 (Neighborhood Retail Business) to District CP-1 (Neighborhood Planned Business Center), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2581, rezoning an area of approximately 1.26 acres generally located north of 107th Street on the west side of Blue Ridge Boulevard (10604 and 10610 Blue Ridge Boulevard) from District C-1 (Neighborhood Retail Business) to District CP-1 (Neighborhood Planned Business Center), said section to read as follows:

 

Section 65.010A2581. That an area legally described as:

 

Lot 7 and 8, Perkins Gardens, a subdivision lying in Kansas City, Jackson County, Missouri.

 

is hereby rezoned from District C-1 (Neighborhood Retail Business) to District CP-1 (Neighborhood Planned Business Center), all as shown outlined on a map marked Section 65.010A2581, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer provide for fire protection as required by the Fire Department.

 

2. That the developer extend water mains as required by the Water Department.

 

3. That the developer construct sidewalks along Blue Ridge Boulevard.

 

4. That the developer contribute to the I-435/I-470 Corridor Study Improvement Fund at a rate of $1.00 per gross square foot of office space and $2.00 per gross square foot

of retail space, a total contribution of $16,260.00.

 

5. That the developer close the northern driveway if a joint access agreement is secured with the property owner to the north.

 

6. That the developer combine the two platted lots into one lot.

 

7. That the developer submit a final plan for each stage to the City Plan Commission for approval. The final plan shall include: site plan, dimension plan, grading plan,

landscape plan, and signage plan.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 950368, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
