COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050241

 

Approving the Amended and Restated Grand Avenue South Urban Renewal Plan for an area of approximately 42 acres generally bounded by 18th Street on the north, Cherry Street and the north-south alley east of Cherry Street on the east, 20th Street and the KC Terminal tracks on the south and the north-south alley west of Grand Boulevard on the west. (301-S-1)

WHEREAS, by passage of Ordinance No. 55560, passed November 23, 1983, the City Council approved a general urban renewal plan for the Grand Avenue South Urban Renewal Project; and

  WHEREAS, it is desirable and in the public interest that the Grand Avenue South Urban Renewal Plan be modified to expand the list of uses that qualify for Chapter 99 abatement from industrial and mixed use to mixed use, and for the deletion of the 2.9 acre area of the Western Auto PIEA Plan from the urban renewal plan area; and

WHEREAS, a copy of the amendment has been filed with the City Clerk; and

  WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on January 21, 2005, adopt Resolution No1-6-05 recommending approval of the Urban Renewal Area to allow for the expansion of the list of uses that qualify for Chapter 99 abatement from industrial and mixed use to mixed use, and for the deletion of the 2.9 acre area of the Western Auto PIEA Plan from the urban renewal plan area; and

  WHEREAS, the City Plan Commission reviewed the amendment to the Grand Avenue South Urban Renewal Plan to allow for the expansion of the list of uses that qualify for Chapter 99 abatement from industrial and mixed use to mixed use, and for the deletion of the 2.9 acre area of the Western Auto PIEA Plan from the urban renewal plan area on November 16, 2004, said recommendation of the City Plan Commission being set forth on Exhibit A attached hereto and incorporated herein by reference; NOW, THEREFORE,

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section A. That the amendment to the Grand Avenue South Urban Renewal Plan which allows for the expansion of the list of uses that qualify for Chapter 99 abatement from industrial and mixed use to mixed use, and for the deletion of the 2.9 acre area of the Western Auto PIEA Plan from the urban renewal plan area, is hereby approved. A copy of the amendment to the Grand Avenue South Urban Renewal Plan is on file with the office of the City Clerk and is incorporated herein by reference.

  Section B. That the Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, Revised Statutes of Missouri, as amended.

  Section C. That it is hereby found and determined that all of the findings, determinations and conclusions made and set forth in Ordinance No. 055560, passed November 23, 1983, apply with equal force and effect as of the date of this revision.

  Section D. That said Urban Renewal Plan and amendments are hereby found to be feasible and in conformance with the Master Plan for the development of the community as a whole.
