ORDINANCE NO. 200090

 

Authorizing the Director of Public Works to enter into a Road Relinquishment Agreement with the Missouri Highways and Transportation Commission (“MHTC”) for the purpose of transferring ownership and maintenance of a certain portion of U.S. 169 outer roads, including Thomas Meyers Drive from Barry Road south to approximately N.W. 79th Street, N.W. 79th Street from Thomas Meyers Drive to the south termini and the west outer road of U.S. 169 south of Shoal Creek Parkway, from MHTC to the City.

 

WHEREAS, MHTC owns and operates a western outer road of U.S. 169 south of the Barry Road interchange known as Thomas Meyers Drive from Barry Road south to approximately N.W. 79th Street and N.W. 79th Street from Thomas Meyers Drive which has been improved over time by permits issued by the City to upgrade the street to include curbs and street lighting along portions of it and MHTC owns a west outer road of U.S. 169 south of Shoal Creek Parkway which was partially reconstructed in 2013 and serves Northland Christian School and terminates in a dead end at a single family residence; and

 

WHEREAS, all parties believe that it is in the best interests to transfer ownership and control of these outer roads from MHTC to the City as these roads are used by the City to provide public services and operational maintenance of these roads is not to the standard City residents expect as MHTC provides services to routes with higher levels of traffic; and

 

WHEREAS, Committee Substitute for Ordinance No. 190601 stated City Council support for improvements to the Route 152 and Platte Purchase interchange and directed the City Manager to work with the Missouri Department of Transportation to prepare applications for the MoDOT Partnership Development Cost Share Program of which the City received $2,732,741.00 from the program to upgrade the Route 152 and Platte Purchase Interchange to include traffic flow improvements and to provide for bicycle and pedestrian accommodations through the interchange and this was contingent upon the City and MHTC agreeing to further define and officially transfer of ownership of these outer roads after MHTC resurfaces the U.S. 169 outer road; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Public Works Department is hereby authorized to enter into a Road Relinquishment Agreement for the purpose of transferring ownership and maintenance of a certain portion of U.S. 169 outer roads, including Thomas Meyers Drive from Barry Road south to approximately N.W. 79th Street, N.W. 79th Street from
Thomas Meyers Drive to the south termini and the west outer road of U.S. 169 south of Shoal Creek Parkway, from MHTC to the City. A copy of the agreement is on file in the Public Works Director’s Office.
