COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120782

 

Authorizing execution of multi-year master lease agreement with Brightergy Leasing, LLC, for installation of solar energy generation systems on various City buildings and facilities and authorizing the City Manager to expend up to $89,280.00 annually for the lease.

 

WHEREAS, the City of Kansas City, Missouri (“City”) has adopted a Climate Protection Plan with substantial goals to reduce greenhouse gas (“GHG”) emissions from its municipal operations; and

WHEREAS, a major source of GHG emissions from municipal operations is the City’s use of electricity that is generated from the combustion of fossil fuels; and

WHEREAS, the City’s Climate Protection Plan includes a recommendation to increase the amount of electricity that the City generates from clean, renewable sources, such as photovoltaic solar panels; and

WHEREAS, the City desires to reduce the costs incurred from the purchase of fossil-fuel-generated electricity; and

WHEREAS, the City continues to position itself as a regional and national leader in the utilization of clean, green power for its operations; and

WHEREAS, the City supports green job development and green business development in our community; and

WHEREAS, the City can enter into a multi-year lease with a local small business for installation of solar panels on the rooftops of City buildings and facilities that will generate electricity for use by the City at a cost that is less than the City’s current cost of purchasing electricity for use in those buildings and facilities; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute a multi-year master lease agreement with Brightergy Leasing, LLC, for installation, maintenance, and repair of up to 40 solar energy generation systems of 25 kW capacity each at City buildings and facilities with the lease payments not to exceed $89,280.00 annually for a 20-year term. The master lease agreement is approved, in substantial form, and is on file in the City Manager’s office.

Section 2. That the City Manager is authorized to expend up to $89,280.00 from funds previously appropriated to Account No. 1150-071780-615050 to satisfy the cost of the lease for the first year.  Future annual lease payments shall be subject to appropriation.

Section 3. That the City Manager, or his designee, is hereby authorized and directed to take such further action, and execute such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Ordinance and perform the duties of the City with respect to the master lease agreement approved herein.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
