SUBSTITUTE FOR ORDINANCE NO. 130796
Amending Section 68-472.1, Code
of Ordinances, for the purpose of revising the formula for distributing the
public mass transportation sales tax.
BE IT ORDAINED BY THE COUNCIL OF KANSAS
CITY:
Section 1. That
Chapter 68, Article VII, Code of Ordinances of Kansas City, Missouri, entitled
“Sales Taxes,” is hereby amended by repealing Sections 68-472.1, Distribution
of Tax, and enacting in lieu thereof a new section of like number and subject
matter to read as follows:
Sec. 68-472.1. Distribution of
tax.
(a) No less than
ninety-five percent of the proceeds derived from the sales tax imposed by Sec.
68-471 of this article and received by the City shall annually be appropriated
and paid to the Kansas City Area Transportation Authority (KCATA) for such
purposes as are provided in RSMo 92.400—92.421, inclusive. Notwithstanding the
foregoing, the amount to be so appropriated and paid shall be determined only after
the following deductions from such proceeds shall have been made, and none
other:
(1) The
two percent cost of handling authorized by RSMo 92.418.1.
(2) All tax increment financing obligations pursuant to the terms
of the Real Property Tax Increment Allocation Redevelopment Act, RSMo
99.800—99.865, inclusive.
(3) The downtown streetcar subsidy which, for purposes of this
deduction, shall not exceed two million thirty-nine thousand dollars
($2,039,000).
(b)
Notwithstanding the above, pursuant to Resolution 130778, as amended, the City
Manager on an annual basis during budget deliberations shall determine whether
KCATA has demonstrated that it has instituted cost reduction measures.
(c) If the City Manager determines
that KCATA has not demonstrated adequate cost reduction measures, the City
Manager's proposed budget may reflect an appropriation of less than the 95%
required above together with an explanation in the City Manager's budget letter
to Mayor and Council.
