Approving
an amendment to a previously approved development plan in District GP-3 (General
Planned Development District - Regional Business) on approximately a 94.8 acre
tract of land generally bounded by N.W. Barry Road on the south, Interstate 29
on the west, Missouri Highway 152 on the north and N. Ambassador Drive on the

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved development plan in District
GP-3 (General Planned Development District - Regional Business) on
approximately a 94.8 acre tract of land generally bounded by N.W. Barry Road on
the south, Interstate 29 on the west, Missouri Highway 152 on the north and N.
Ambassador Drive on the east, and more specifically described as follows:
All of Lots 1 through 8 and Tracts A and B,
Boardwalk Square; Lot 1, Boardwalk Square, 2nd Plat; and Lots 1 through 8 and
Tract A, Boardwalk Square, 3rd Plat, subdivisions in Kansas City, Platte
County, Missouri, except that area described as: Lot 7, Boardwalk Square, a
subdivision in Kansas City, Platte County, Missouri, and that part of the
Northwest 1/4 of Section 7, Township 51 North, Range 33 West of the 5th P.M.,
Kansas City, Platte County, Missouri, described as follows: Commencing at the
northeast corner of Lot 7, Boardwalk Square, a subdivision of land in said
Northwest 1/4; thence North 90 4500'9200'94 West (all bearings herein are
referenced to the recorded plat of said Boardwalk Square) on the north line of
said Lot 7, 121.00 feet to the point of beginning; thence continuing North 90
4500'9200'94 West on the north line of said Lot 7, 208.32 feet; thence North 30
4500'9200'94 West on said north line, 115.47 feet; thence South 69
4524'9202'94 East, 284.23 feet to the point of beginning.
is
hereby approved, subject to the following conditions:
1. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
2. That
the developer submit a revised storm drainage study to the City Engineers
Office for approval and that the developer make any improvements as required by
the City Engineers Office.
3. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
4. That
the developer comply with the Kansas City International Airport Height Zoning
restrictions.
5. That
the developer provide for fire protection as required by the Fire Department.
6. That
the developer enter into an unsecured deferral agreement with the City as
required by the Department of Public Works prior to the approval of a final
plan whereby the developer agrees to construct a pedestrian sidewalk along the
southerly drive on N. Ambassador Drive as shown on the development plan at such
time as any further expansion of the development occurs.
7. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for grading, landscaping, screening, berming and signage.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 020115, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
