COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 040979

 

Amending the 2004 Housing and Community Development Action Plan in accordance with the National Affordable Housing Act of 1990, as amended; authorizing of providing notification of said Plan amendment to the U.S. Department of Housing and Urban Development.

 

WHEREAS, Congress and the President signed the Cranston-Gonzalez National Affordable Act on November 28, 1990; and

WHEREAS, Title I requires cities to submit to the United States Department of Housing and Urban Development a document which consolidates the previous Comprehensive Housing Affordability Strategy (CHAS) and four federal entitlement programs into a single 5-year document entitled the Consolidated Plan; and

 

WHEREAS, Title I requires cities to submit a five year Consolidated Plan inclusive of a one year Action Plan, and any amendments to the 5-year Plan on an annual basis; and

 

WHEREAS, Title I authorizes the Secretary of the U. S. Department of Housing and Urban Development to award grants to units of local government, such as the City of Kansas City, Missouri, to finance its Community Development and Housing Programs; and

 

WHEREAS, the four grant programs included within the 2004 Consolidated Action Plan are the Community Development Block Grant Program, the HOME Investment Partnership Act Program, the Emergency Shelter Grant Program, and the Housing Opportunities for Persons with AIDS Program; and

 

WHEREAS, the City Council of Kansas City, Missouri approved the 2004-2008 Consolidated Plan and 2004 Consolidated Action Plan on February 26, 2004, and authorized its submission on March 5, 2004 for the four programs pursuant to and in accordance with Title I of the National Affordable Housing Act of 1990, as amended, and appropriate administrative rules and regulations promulgated and adopted under such Act; and

 

WHEREAS, on May 14, 2004 the Department of Housing and Urban Development issued approval of Kansas Citys 2004-2008 Consolidated Plan and 2004 Action Plan; and

 

WHEREAS, the 2004 Citizen Participation Plan and Application Guide provides guidance on any substantial amendments to the approved Consolidated Plan; and

 

WHEREAS, on June 30, 2004, the Department of Housing and Community Development, which was listed as the lead agency in the 2004-2008 Consolidated Plan and 2004 Action Plan was formally dissolved; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the 2004-2008 Consolidated Plan and 2004 Housing and Community Development Action Plan be amended in accordance with the Citizen Participation Guide of the approved Consolidated Plan, to designate the lead entity for the City of Kansas City, Missouri as the Office of Management and Budget.

 

Section 2. That the 2004 Action Plan be amended to include the Housing Court Program and its administration as a new activity to be implemented within the 2004 program year, which will not necessitate any adjustment to the 2004 Consolidated Plan Budget.

 


Section 3. That the 2004 Action Plan be amended to allow the use of City Program Income for the purpose of providing second mortgage assistance to a maximum of five (5) above 80% income eligible homebuyers only in the 53rd and Woodland Area.

 

Section 4. That the 2004 Consolidated Plan Budget be amended to reflect the following:

 

C Reduce allocation from Model Block Program (South Round Top) from City Program Income resources by $50,000.00.

 

C Reduce allocation from HEDFC (CDBG) Second Mortgage Program from HEDFC Program Income resources by $50,000.00.

 

C Increase allocation to Model Block Program (South Round Top) by HEDFC Program Income by $50,000.00.

 

C Increase HEDFC (CDBG) Second Mortgage Program from City Program Income by $50,000.00.

 

Section 5. That the 2004 Consolidated Plan be amended to allow for the lease/purchase of single family homes with HOME Investment Partnership funds.

 

Section 6. That the City Council hereby authorizes that proper and appropriate notification to be made to the U.S. Department of Housing and Urban Development pursuant to these amendments.
