ORDINANCE NO. 180658

 

Accepting the recommendations of the Tax Increment Financing Commission as to the termination of the Americana Hotel Tax Increment Financing Plan; terminating the Americana Hotel Tax Increment Financing Plan and Redevelopment Area; terminating the designation of redevelopment project areas; declaring as surplus those funds within the special allocation funds established in connection with the Americana Hotel Tax Increment Financing Plan, if any; authorizing the distribution of such surplus funds to the taxing jurisdictions; and directing the City Clerk to transmit copies of this ordinance.

 

WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statues of Missouri, as amended, (the “Act”), the City Council created the Tax Increment Financing Commission of Kansas City, Missouri (the “Commission”); and

 

WHEREAS, the Council, by the passage of Ordinance No. 921438 on January 28, 1993, approved the Americana Hotel Tax Increment Financing Plan (the “Plan”) and designated an area described by the Plan as a redevelopment area (the “Redevelopment Area”); and

 

WHEREAS, the Council, by the passage of Ordinance No. 921439 on April 6, 1995, approved tax increment financing for Project 1 of the Plan; and

 

WHEREAS, the Plan area is generally bounded 13th Street on the north, Baltimore Avenue on the east, 14th Street on the south, and Wyandotte Street on the west in Kansas City, Jackson County, MO; and

 

WHEREAS, the 23-year period for the capture of tax increment allocation financing for Project 1 has expired and ordinances to approve tax increment financing for Projects 2 and 3 were never approved and were released by the City Council on January 22, 2008; and

 

WHEREAS, on June 13, 2018, the Commission recommended termination of the Plan; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the recommendations of the Commission concerning the termination of the Americana Hotel Tax Increment Financing Plan are hereby accepted and the Americana Hotel Tax Increment Financing Plan and Redevelopment Area are hereby terminated; and the designation of the redevelopment projects within the Redevelopment Area is hereby terminated.

 

Section 2. That following the distribution of the surplus funds, if any, the special allocation fund for the Americana Hotel Tax Increment Financing Plan is dissolved.

 

Section 3. That the City Clerk shall send a copy of this ordinance to the County Clerk and County Executive of Jackson County, Missouri.
