Approving rezoning on approximately
a 0.33 acre tract of land generally located at the southwest corner of Charlotte Street and 5th Street from District R-4 to District URD, and approving a development
plan for the same. (13903-URD-1)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0811, rezoning an area of approximately a 0.33 acre tract of land generally located at the southwest
corner of Charlotte Street and 5th Street from District
R-4 (Low Apartments) to District URD (Urban Redevelopment District), said
section to read as follows:
All of Lots 11 and
12, Block 54, East Kansas, a subdivision in Kansas City, Jackson County,
Missouri, more particularly described as follows: Beginning at the Northwesterly
corner of said Lot 12; Thence South 14 38 11 East, a distance of 100.65 feet
to the Northeasterly corner of said Lot 12; Thence North 75 39 37 East, a
distance of 142.01 feet to the Southeasterly corner of said Lot 11; Thence
North 14 34 38 West, a distance of 100.62 feet to the Southwesterly corner
of said Lot 11; Thence South 75 38 54 West, a distance of 141.91 feet to the
Point of Beginning.
is hereby rezoned from District
R-4 (Low Apartments) to District URD (Urban Redevelopment District), all as
shown outlined on a map marked Section 80-11A0811, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a micro storm drainage study to Development
Services for review and acceptance for this phase when the final plat is
submitted, and that the developer construct any improvements as required by
Development Services.
3.
That the developer submit a letter from a licensed civil engineer,
licensed architect, or licensed landscape architect, who is registered in the
State of Missouri, stating the condition of the sidewalks, alleys, curbs, and
gutters. The letter must identify state of repair as defined in Chapters 56
and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall
identify the quantity and location of sidewalks, alley, curbs and gutters that
need to be constructed, repaired, or reconstructed. The developer shall secure
permits to repair or reconstruct the identified sidewalks, alley, curbs, and
gutters as necessary along all development street frontages, as required by
Development Services, prior to recording the plat.
4.
That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities.
5.
That the developer provide individual sanitary sewer service to
all proposed units and determine adequacy as required by Development Services.
6.
That the developer submit covenants, conditions and restrictions
to Development Services for approval by the Law Department for the maintenance
of common elements and enter into a covenant agreement for the maintenance of
any BMPs, stormwater detention area tracts, and brick pavers in the
right-of-way.
7.
That the developer pay money in lieu of parkland dedication in
the amount of $630.56 based on the calculation of 5 x 2 x .006 x $10,509.41 in
satisfaction of Section 66-128 of the Subdivision Regulations.
8.
That the developer submit a final site plan to the Director of
the Department of City Development for approval prior to the issuance of a
building permit. The site plan shall include information regarding: property
uses, setback distances, lighting, landscaping and architectural
characteristics, berms, trees and plantings around and within the parking lots;
show proposed pedestrian circulation; and include elevation drawings of
buildings.
9.
That the developer secure permits to
construct a streetscape along 5th Street as identified in the 5th Street streetscape plan as required by Development Services.
10.
That the requirement to dedicate six
feet of right of way for a bike lane on 5th Street as well as Charlotte Street
is waived.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
