COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 041380

 

Amending Ordinance No. 951470 by repealing its Section 2 and enacting in its place a new Section 2, correcting the legal description of Project A of the Tower Properties Tax Increment Financing Plan as a Redevelopment Project, and affirming the prior adoption of tax increment financing therein.

 

WHEREAS, the City Council of Kansas City, Missouri (City Council), by Ordinance No. 54556, passed on November 24, 1982, and thereafter amended in certain respects by Ordinance No. 911076, passed on August 29, 1991, created the Tax Increment Financing Commission of Kansas City, Missouri (the Commission); and

WHEREAS, on November 27, 1995, the City Council passed Ordinance No. 951469, which approved the Tower Properties Tax Increment Financing Plan (the TIF Plan) and designated the Redevelopment Area as a blighted area; and

 

WHEREAS, on December 17, 1998, the City Council passed Ordinance No. 951470, which approved Project A of the Tower Properties Tax Increment Financing Plan as a Redevelopment Project and adopted tax increment financing therein; and

 

WHEREAS, the Project A legal description set forth in Section 2 of Ordinance No. 951470 contained a scriveners error inadvertently omitting from Project A the northern half of the property at the southwest corner of 9th Street and Walnut Street upon which a parking garage was to be constructed as a Redevelopment Project pursuant to the TIF Plan; and

WHEREAS, when enacting Ordinance No. 951470, it was the City Councils intent that Project 8 be comprised of the property legally described herein, the entire parking garage property; and

WHEREAS, it is necessary to correct the Ordinance No. 951470 Section 2 Project A legal description in order to properly implement tax increment financing thereon as intended by Ordinance No. 951470; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 951470 is hereby amended by repealing Section 2 of that ordinance and enacting in its place a new section 2, to read as follows:

 

Section 2. The area selected for Project A, legally described as follows:

 

Lots 2, 3, 4 and 5, and South 4 feet of Lot 1, Block 2 (except in Walnut Street), Ridges Place, and East of vacated alley lying West of and adjacent to, also known as 900-906 Walnut, Kansas City, Missouri.

 


West 110.5 feet of Lot 6 and West 110.5 feet of North 16 feet of Lot 7, Block 2, Ridges Place, and East of vacated alley lying West of and adjacent to, also known as 908-910 Walnut, Kansas City, Missouri.

 

West 110.5 feet of South 9 feet of Lot 7 and West 110.5 feet of Lot 8 and North 23 feet 6- inches of West 110.5 feet of Lot 9, Block 2, Ridges Place, and East of vacated alley lying West of and adjacent to, also known as 916 Walnut, Kansas City, Missouri.

 

South 1 foot 5-4/5 inches of Lot 9 and North 24 feet 4-1/5 inches of Lot 10, Block 2 (except in Walnut Street), Ridges Place, and East of vacated alley lying West of and adjacent to, and West of vacated alley lying East of and adjacent to, also known as 920 Walnut, Kansas City, Missouri.

 

is approved and designated as Project A of the Tower Properties Tax Increment Financing Plan, as amended, and tax increment allocation financing is adopted therein, effective December 17, 1998 (the Original Effective Date). The actions of all City officials and the Tax Increment Financing Commission of Kansas City, Missouri, in allocating, paying, depositing, receiving and/or disbursing payments in lieu of taxes or economic activity taxes for areas within the area described by this ordinance, which have been approved after the Original Effective Date, but prior to the effective date of this ordinance, are hereby ratified and approved. As and from the Original Effective Date, the Project A propertys certified total initial equalized assessed value is the Project A propertys assessed value in the year 1998, and payments in lieu of taxes generated therefrom shall be allocated, collected, paid and deposited into the Tower Properties Downtown Redevelopment Special Allocation Fund as described in the TIF Act and Section 3 of this ordinance.
