COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050007

 

Amending a previously approved preliminary development plan for a GPA District on a 23.54 acre tract of land generally located at the southwest corner of Meers Road and View High Drive. (13032-GP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District GPA (Agricultural) on approximately a 23.54 acre tract of land generally located at the southwest corner of Meers Road and View High Drive, and more specifically described as follows:

 

PARCEL I: A parcel of land in the Southeast Quarter of Section 33, Township 48, Range 32, Jackson County, Missouri Recorded as Document No. 1475547, Book I1119, Page 2182, with the Recorder of Deeds Office, Independence, Jackson County, Missouri (and hereafter referred to as Parcel A) more particularly described as follows: Commencing at the Southeast corner of the North One Half of the Northeast Quarter of the Southeast Quarter Section 33, Township 48, range 32: thence North 86 degrees 54 minutes 33 seconds West (Deed), North 86 degrees 55 minutes 24 seconds West (Measured), along the South line of said North One Half, a distance of 649.75 feet (Deed) 649.63 feet (Measured) to a point, said point being on the centerline of existing Meers Road; thence South 2 degrees 26 minutes 14 seconds West (Deed), South 2 degrees 34 minutes 52 seconds West (Measured), a distance of 25.00 feet to a point of intersection of the South Right of Way of Meers Road (as per Meers Road Right of Way Document No. 584149, Bk. 927, Pg. 679) with the West Right of Way of View High Drive, said point being the true point of beginning of said Parcel A; thence South 2 degrees 26 minutes 14 seconds West (Deed), South 2 degrees 34 minutes 52 seconds West (Measured) along the West Right of Way of said View High Drive as not exist, a distance of 125.13 feet (Measured) to a point of curvature; thence continuing along the West Right of Way line on a curve to the left, said curve having an initial Tangent Bearing of South 22 degrees 20 minutes 22 seconds West (Deed), south 22 degrees 19 minutes 00 seconds West (Measured), a radius of 1115.00 feet, a Central Angle of 34 degrees 18 minutes 08 seconds for a arc length of 667.54 feet (Deed), 667.82 feet (Measured), to the South line of Parcel A; thence North 86 degrees 38 minutes 45 seconds West (Deed), North 86 degrees 38 minutes 34 seconds West (Measured), a distance of 639.33 feet (Deed), 639.64 feet (Measured), to the Southwest corner of said Parcel A being on the West line of the Southeast quarter of the Southeast Quarter of said Section 33; thence North 2 degrees 32 minutes 49 seconds East (Deed), North 2 degrees 32 minutes 12 seconds East (Measured), along the West line of Parcel A, being the West line of said Southeast Quarter of the Southeast Quarter of said Section 33, a distance of 745.38 feet to the South Right of Way line of Meers Road; thence along the South Right of Way line of said Meers Road North 73 degrees 34 minutes 35 seconds East 8.43 feet to a point of curvature; thence continuing along the South Right of Way line on a curve to the right, said curve having a Radius of 545.33 feet, a Central Angle of 10 degrees 30 minutes 24 seconds for a arc length of 185.60 feet; thence continue along said South line South 86 degrees 55 minutes 24 seconds East, a distance 479.49 feet to the point of beginning, said Parcel A containing 489,193.470 sq. ft. or 11.230 acres of land.

 

PARCEL II: A strip of land 23.62 Poles (389.73 feet) wide off the East side of the West one-half of the Southeast Quarter, lying South of Meers Road as now established, and except the South 416.9 feet thereof, all in Section 33, Township 48, Range 32, in Jackson County, Missouri.

is hereby approved, subject to the following conditions:

 

1.               That the proposed sign receive approval of an encroachment ordinance for installation within the public right-of-way.

 

2.               That the developer construct with this phase a sidewalk along the east side of the entrance drive from View High Drive.

 

3.               That the developer submit a final plan to the City Plan Commission for approval, including a final site plan, grading plan, landscaping plan, signage plan and lighting plan, including a photometric study.

 

4.               That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

5.               That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

6.               That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7.               That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

8.               That the developer construct all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and foundations.

 

9.               That the developer extend sanitary sewers as required by the Department of Public Works.

 

10.              That the developer relocate any storm sewers if required by the City Engineers Office.

 

11.              That the developer enter into a secured deferral agreement with the final plat to provide for the improvement of the south half of Meers Road to collector street standards including curb, gutter, sidewalks and streetlights with Phase 2 or when the north side of Meers Road is further improved, whichever occurs first; however, if this improvement has not been made eight years from the date of this ordinance, developer may request and the Director of Public Works is authorized to reevaluate the required timeframe for this improvement.

 

12.              That the developer submit design plans and support documentation for the left turn lane as required by the Department of Public Works and obtain permits for the construction of the turn lane.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 050007, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices have been given and hearings have been held as required by the Zoning Ordinance have been given and had.
