ORDINANCE NO. 050835

 

Detaching approximately 10.57 acres generally located along the east side Missouri Route 169, between NW 43rd Street on the south and NW Vivion Road on the north which will be concurrently annexed by the City of Gladstone, contingent upon Gladstones placement of a permanent restriction on the use of the property for outdoor advertising purposes. (100-AN-3)

 

WHEREAS, the City of Gladstone operates a water treatment plant located within the limits of Kansas City; and

 

WHEREAS, the City of Gladstone and the City of Kansas City agree that protection and operation of the water treatment plant would be more efficiently achieved if the City of Gladstone possessed governmental police power over the property on which its water treatment plant is located, but that the Kansas Citys interest in keeping the property free from outdoor advertising should also be protected; and

 

WHEREAS, the property to be concurrently detached by Kansas City and annexed by Gladstone abuts Gladstone; and

 

WHEREAS, all provisions of Section 71.011, Revised Statutes of Missouri, authorizing such concurrent detachment and annexation have been met; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Detachment and Annexation of Property. That the following property, generally located along the east side Missouri Route 169, between NW 43rd Street on the south and NW Vivion Road on the north, and more specifically described as:

 

All that part of the West Half of the Northeast Quarter of Section 3, Township 50, North Range 33 West in Clay County, Missouri, being more particularly described as follows: Commencing at the Southeast corner of the Northeast Quarter of said Section 3; thence North 89 16 51 West along the south line of the Northeast Quarter of said Section 3, a distance of 1998.02 feet to the Southwest corner of the East Half of the West Half of the Northeast Quarter of said Section 3, said point being the true point of beginning; thence continuing North 89 16 51 West along the South line of the Northeast Quarter of said Section 3, a distance of 360.19 feet to a point on the Easterly right of way line of U.S. Highway 169; thence North 00 42 57 East along the East right of way line of said U.S. Highway 169, a distance of 705.88 feet; thence North 12 44 29 East and continuing along the East right of way line of said U.S. Highway 169, a distance of 758.41 feet; thence along a curve to the right and continuing along the East right of way line of said U.S. Highway 169, said curve having a radius of 3619.83 feet and a chord bearing of North 17 47 29 East, and an arc distance of 671.33 feet to a point on the West line of the East Half of the West Half of the Northeast Quarter of said Section 3; thence South 00 34 09 West along the West line of the East Half of the West Half of the Northeast Quarter of said Section 3, a distance of 482.38 feet to a point on the West line of Lot 1 in Claymont Pointe, a subdivision in Clay County, Missouri; thence South 15 56 56 West along the West line of said Lot 1, a distance of 59.97 feet; thence South 18 15 42 West and continuing along the West line of said Lot 1, a distance of 557.18 feet; thence South 45 44 47 East and continuing along the West line of said Lot 1, a distance of 256.15 feet to a point on the West line of the East Half of the West Half of the Northwest Quarter of said Section 3; thence South 00 34 09 West along the West line of the East Half of the West Half of the Northwest Quarter of said Section 3, a distance of 840.55 feet to the point of beginning; containing 10.57 acres, more or less and being subject to all easements, conditions, restrictions, rights of way, and reservations, now of record.

 

is hereby declared to be detached by the City of Kansas City effective upon the simultaneous and concurrent attachment of this property by the City of Gladstone, and upon the filing by the City of Gladstone of a deed restriction or other permanent promise that no outdoor advertising will be permitted or placed on the property.

 

Section 2. Reason and Purpose for the Detachment and Annexation. That the reasons for and purposes to be accomplished with this concurrent detachment by the City of Kansas City and the annexation by Gladstone are: such action will allow Gladstone to use its resources for the protection and operation of the water treatment plant, thus benefiting the citizens of both municipalities.

 

Section 3. Ban on Outdoor Advertising at the Site. That the City of Gladstone has removed outdoor advertising from the site of the water treatment plant, and that the City of Kansas City believes the absence of outdoor advertising at the site is essential to the proper development of Kansas City in this area, therefore, this detachment is contingent upon the filing by the City of Gladstone of a deed restriction or other permanent promise forever barring outdoor advertising at the site of the property, and filing of the document before or with the ordinances providing for the concurrent detachment and annexation of the property.

 

Section 4. Filing. That the City of Gladstone will file a certified copy of this ordinance simultaneously with the filing of a certified copy of the related annexation ordinance adopted by the City of Gladstone in the office of the County Clerk of Clay County, the Recorder of Deeds of Clay County, and the Clerk of the Circuit Court of Clay County, at its cost.
