ORDINANCE NO. 120963

 

Repealing Ordinance No.120822, which authorized condemnation and taking private property in fee simple for public use for Redevelopment Project No. 87007315 (Beacon Hill); enacting a new ordinance authorizing condemnation, taking private property in fee simple for public use for Redevelopment Project No. 87007315 (Beacon Hill), all in Kansas City, Jackson County, Missouri; renewing a determination of economic blight; receiving new evidence of economic and social blight; making a determination of economic and social blight; providing for the payment of just compensation for property condemned; authorizing continued negotiations and purchase by the Director of Neighborhoods and Housing Services Department; authorizing the filing of the petition for condemnation by the City Attorney on behalf of the City; and directing the City Clerk to record this ordinance in the office of the Recorder of Deeds for Jackson County.

 

WHEREAS, Ordinance No. 120822 was for the condemnation of private property for said redevelopment project; and

 

WHEREAS, different and additional property is needed for said redevelopment project; and

WHEREAS, the Council approved the Beacon Hill Redevelopment Plan in Ordinance No. 020442 and made a determination of economic blight in the area, which determination was extended by Ordinance No. 090770; and

WHEREAS, the Council finds that a preponderance of the property in the Beacon Hills Redevelopment Plan is and continues to be a social and economic blight in accord with Section 353.020(2), RSMo., and must be condemned in fee simple for public use for redevelopment, in Kansas City, Jackson County, Missouri; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the blight finding made in Ordinance Nos. 020442 and 090770 is hereby renewed.

Section 2. That the Council has considered the economic and social blight evidence regarding each property in the redevelopment area presented by staff and hereby finds a preponderance of economic and social blight in the redevelopment area.

Section 3. That the fee interests in private properties are hereby authorized condemned and taken for public use in and upon the land hereinafter described for Project No. 87007315, Beacon Hill Redevelopment, including any necessary structures or appurtenances, in Kansas City, Jackson County, Missouri.

Section 4. Said improvements shall be of the nature described and specified in, and shall be done in accordance with, the plans and specifications on file in the Office of the Director of City Planning and Development, and being incorporated herein by reference.

Section 5. That the properties shall be used by Kansas City or its redeveloper as the location of improvements to be constructed therein including any necessary appurtenances to it; and Kansas City or its redeveloper shall have the right to enter in or authorize the entry in and upon said properties for the purpose of constructing, reconstructing, maintaining, operating and repairing said improvements.

Section 6. That the private properties are hereby authorized condemned in a proceeding instituted in Jackson County, Missouri, by the City Attorney and taken for public use and hereby described as follows:

 

2218 Tracy: Lot 25, Block G, Victor Place, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

2221 Tracy: The North 10 feet of Lot 4 and all of Lot 5, Rogers’ Subdivision, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

2225 Tracy

Tract 1: Tract North 12.8 feet of Lot 3, and the South 15 feet of Lot 4, Rogers’ Subdivision, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; and

 

Tract 2: The West 79.5 feet of the North 22 feet of Lot 2, and the West 79.5 feet of the South 12.2 feet of Lot 3, Rogers’ Subdivision, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

2209 Tracy: The North 20 feet of Lot 5, all of Lot 6, and the South 10 feet of Lot 7, Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

2207 Lydia: The South 25 feet of the North 105 feet of Lots 18 and 19 and the South 25 feet of the North 105 feet of the West 16.5 feet of Lot 20, Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

2216 Lydia: Lot 32, Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, subject to that part in road, according to the recorded plat thereof.

1323 E 22nd Street: All of Lots 16 and 17, Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, except that part described as follows: All that part of Lots 16 and 17 Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the Northwest corner of Lot 16; thence South 87 degrees 27 minutes 51 seconds East, a distance of 50.26 feet to a point; thence South 02 degrees 10 minutes 35 seconds West, a distance of 70.00 feet to a point; thence North 87 degrees 27 minutes 51 seconds West, a distance of 50.28 feet to a point; thence North 02 degrees 11 minutes 37 seconds East, a distance of 70.00 feet to the point of beginning.

 

Also further excepting: All that part of Lot 17, Mount Prospect Addition, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the Northwest corner of Lot 16; thence South 87 degrees 27 minutes 51 seconds East, a distance of 50.26 feet to a point; thence South 02 degrees 10 minutes 35 seconds West a distance of 70.00 feet to a point; thence continuing South 02 degrees 10 minutes 35 seconds West a distance of 50.00 feet to the true point of beginning; thence South 47 degrees 21 minutes 22 seconds West a distance of 14.10 feet to a point; thence South 87 degrees 27 minutes 51 seconds East a distance of 10.00 feet; thence North 02 degrees 10 minutes 35 seconds East a distance of 10.00 feet to the true point of beginning.

 

Also, any interests in said Tracts 16 and 17 occurring as part of Jackson County property tax sale of 2012.

Section 7. That just compensation for the properties taken shall be assessed and paid according to law; and the proceedings to determine compensation shall be prosecuted in one or more suits in the Circuit Court of Jackson County, Missouri, pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, as supplemented or amended by Section 86.01 to 86.10 of the Rules of Civil Procedure. Payment of compensation shall be made by Kansas City from funds appropriated for such purposes.

Section 8. That pending the acquisition of said lands by condemnation, the Director of Neighborhoods and Housing Services Department is hereby authorized to negotiate the purchase of said land and pay for them out of funds appropriated or to be appropriated as aforesaid, and if any tracts be so acquired by negotiation and purchase, the City Attorney is authorized to withdraw same from condemnation proceedings.

Section 9. That said properties be condemned and conveyed to either Kansas City, Missouri or Beacon Hill Redevelopment Corporation in fee simple.

Section 10. That upon the effective date of this ordinance, the City Clerk is hereby directed to record this ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.
