ORDINANCE NO. 200704

 

Authorizing the City Attorney to execute a professional services agreement with McKinzie & Associates, LLC, in an amount not to exceed $15,000.00 for services in a lawsuit captioned Thompson, et al., v. City of KCMO, Case No. 2016-CV12492.

 

WHEREAS, pursuant to Ordinance No. 200399, all professional services contracts and sole source waivers must be approved by Council; and

 

WHEREAS, a lawsuit has been filed against the City related to a motor vehicle accident which occurred in Kansas City, Jackson County, Missouri; and

 

WHEREAS, the City is in need of expert assistance in accident reconstruction, causation analysis, and investigation related to such claims; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute a sole source contract waiver pursuant to Code of Ordinances Section 3-7(c), should he find it in the best interest of the City.

 

Section 2. That the City Attorney is hereby authorized to enter into a professional services agreement with McKinzie & Associates, LLC, should a sole source contract waiver be executed, in an amount not to exceed $15,000.00 for expert services in litigation pending against the City, from funds appropriated from Account No. 21-7010-131506-B.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
