ORDINANCE NO. 050245
Authorizing a Second Supplement
to the Municipal Agreement and a Utility Agreement with the Missouri Highways
and Transportation Commission relating to public improvements designated as
Route I-470/I-435; and directing the City Clerk to file certain documents with
the appropriate offices.
WHEREAS, by Ordinance
031044, passed October 9, 2003, the Council authorized an Municipal Agreement
with the Missouri Highways and Transportation Commission relating to the design
and construction Hickman Mills and Longview Road;
WHEREAS, by Ordinance
041393, passed December 16, 2004, the Council authorized a First Supplement to
the Municipal Agreement and the expenditure of $2,989,800.00 on the project,
WHEREAS, the City
authorizes the Commission to apply for additional STP-Urban funds which will
reduce the Citys obligation from $2,989,800.00 to $881,900.00; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Public Works is hereby authorized, on behalf of the City, to enter
into and execute, a Second Supplement to the Municipal Agreement and a Utility
Agreement with the Missouri Highways and Transportation Commission relating to
a public improvement designated as Route I-470/I-435, Jackson County, Council
District 6, Project No. 8049, Job Nos. J4I0766K and J4I0766L, for the design
and construction of Hickman Mills Drive improvements, and pedestrian path along
Heart Grover Creek and Hickman Mills Drive. The agreements, in substantial
form, shall be attached and incorporated herein by reference.
Section 2. That
the City Clerk is hereby directed to file a copy of this ordinance, together
with the agreements, with the Office of the Secretary of State of Missouri and
with the Recorder of Deeds for Jackson County, Missouri, together with all
other relevant documents.

I hereby certify that there is a balance,
otherwise unencumbered, to the credit of the appropriation to which the
foregoing expenditure is to be charged, and a cash balance, otherwise
unencumbered, in the treasury, to the credit of the fund from which payment is
to be made, each sufficient to meet the obligation hereby incurred.
