COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 120316
Appropriating $470,833.00 from
the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund for
various Sixth District Neighborhood Conservation Projects; stating the Mayor
and City Council’s intention regarding advance funding for certain capital
projects; and recognizing an emergency.
WHEREAS,
the City Council previously approved Ordinance No. 120066, which approved the
Fiscal Year 2013-17 Five-Year Capital Improvements Program; and
WHEREAS, the
Sixth Council District previously allocated $470,833.00 to their neighborhood
contingency for future use; and
WHEREAS, these
funds are now needed to adhere to various project timelines; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That
the sum of $470,833.00 is appropriated from the Unappropriated Fund Balance of
the Capital Improvements Sales Tax Fund to the following accounts:
12-3090-898601-B-89008020 Holmes
& 135th Intersection $200,000.00
12-3090-708609-B-70139904 Armour
Hills HOA Tree Planting 90,000.00
12-3090-708609-B-70134912 Minor Park
Parking Lot Lighting 97,250.00
12-3090-708609-B-70131302 Blue River
Trail 83,583.00
TOTAL
$470,833.00
Section 2. That
it is the intent of the Mayor and City Council to repay the Capital
Improvements Sales Tax Fund from Neighborhood Conservation funds programmed in
FY 2012-13 for the Council District 6 Neighborhood Conservation Funds per
Committee Substitute for Resolution No. 090341 as follows:

Section 3. That this ordinance, relating to the
design, repair, maintenance or construction of a public improvement, is
recognized as an emergency measure within the provisions of Section
503(a)(3)(D) of the City Charter and shall take effect in accordance with that
section.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
