RESOLUTION NO. 100292

 

Authorizing the City Manager to execute an asset transfer agreement with the Board of the Metropolitan Ambulance Services Trust.

 

WHEREAS, the City executed a Trust Indenture on September 11, 1979, establishing the Metropolitan Ambulance Services Trust; and

WHEREAS, the Metropolitan Ambulance Services Trust is a public trust created and established by, and for the use and benefit of, the City for the purpose of providing ambulance services; and

WHEREAS, the Metropolitan Ambulance Services Trust is governed by a Board of Trustees authorized to hold and manage all Trust property; and

WHEREAS, the City accepted the beneficial interest in the Metropolitan Ambulance Services Trust on September 6, 1979, subject to the Trust Indenture; and

WHEREAS, the Metropolitan Ambulance Services Trust is the sole provider of pre-hospital emergency and non-emergency transport services in the City; and

WHEREAS, the City’s interests have moved progressively toward greater integration of all aspects of the emergency medical services system as a principal component of its efforts to further enhance both the efficacy and the efficiency of the emergency medical services provided for its citizens and visitors; and

WHEREAS, the City created an Emergency Medical Services Advisory Committee, pursuant to Resolution No. 090074, to study and report on potential improvements to the City’s emergency medical system and such Committee recommended integrating ambulance service into the City; and

WHEREAS, Resolution No. 090232, as amended, accepted the recommendation of the Emergency Medical Services Advisory Committee that ambulance service be integrated into the City; and

WHEREAS, the City Council has concluded that the integration of ambulance services into the City can best be accomplished by incorporating the delivery and management of ambulance services into the City’s Fire Department, therefore, the City as beneficiary of the Metropolitan Ambulance Services Trust desires to terminate such Trust; and

WHEREAS, the City, as the Beneficiary of the Metropolitan Ambulance Services Trust, and the Board as Trustees of such Trust desire and believe it necessary to enter into an asset transfer agreement for the proper transfer of assets from the Trustees to the City and to effect the orderly transition of ambulance services from such Trust to the City; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY: 

 

That the City Manager is authorized to execute an asset transfer agreement with the Board of Trustees of the Metropolitan Ambulance Services Trust for the purpose of transferring the assets of such Trust to the City and effecting the orderly transition of ambulance services from such Trust to the City.
