ORDINANCE
NO. 160946
Rezoning a 3.2 acre tract
generally located south of E. 31st Street, west of Mersington Avenue, north of
E. Linwood Boulevard and east of Cleveland Avenue, from Districts R-5, R-1.5
and B-3.2 to District O-2; repealing Ordinance No. 160143. (14616-P)
WHEREAS, the
City Council enacted Ordinance No. 160143 on March 24, 2016, which rezoned the
property that is the subject of this ordinance; and
WHEREAS, said
ordinance contained an incorrect legal description of the property being
rezoned, and this ordinance will correct said legal description, and therefore
correctly rezone the intended property; NOW THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning and Development Code, is hereby amended by enacting a new
section to be known as Section 88-20A1043, rezoning an approximately 3.2 acre
tract generally located south of E. 31st Street, west of Mersington Avenue,
north of E. Linwood Boulevard and east of Cleveland Avenue, from Districts R-5
(Residential 5), R-1.5 (Residential 1.5) and B-3.2 (Community business, dash 2)
to District O-2 (Office dash 2); said section to read as follows:
Section 88-20A1043. That an area
legally described as:
All of Lots 1 through 17, Block 2, Amended
Plat of Parish Park, a subdivision in Kansas City, Jackson County, Missouri;
and
All of Lots 17, 18, 19, 30, 31 and 32,
Osborne Place, a subdivision in Kansas City, Jackson County, Missouri.
all as shown outlined on a map
marked Section 88-20A1043, which is attached hereto and made a part hereof, and
which is hereby adopted as a part of an amendment to the zoning maps
constituting a part of said chapter and in accordance with Section 88-20
thereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
and Development Code have been given and had.
Section C. That Ordinance
No. 160143, enacted by this Council on March 24, 2016, is hereby repealed.
