ORDINANCE NO. 981416
Approving the preliminary plat of Dolce Vita on
approximately a 2.2 acre tract of land generally located 1,200 feet east of N.
Troost Avenue at N.E. 82nd Terrace. (SD 0843)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That the preliminary
plat of Dolce Vita on approximately a 2.2 acre tract of land generally located
1,200 feet east of N. Troost Avenue at N.E. 82nd Terrace, and more specifically
described as follows:
A tract of land located
in the Northwest Quarter of the Southwest Quarter of Section 12, Township 51,
Range 33, Kansas City, Clay County, Missouri, being more particularly described
as follows: Beginning at the southeast corner of the Northwest Quarter of said
Southwest Quarter; thence North 8833'09" West along the south line of the
Northwest Quarter of said Southwest Quarter, a distance of 338.88 feet; thence
North 0100'33" East, a distance of 282.23 feet; thence South
8833'07" East, a distance of 335.87 feet to a point of the east line of
the Northwest Quarter of said Southwest Quarter; thence South 0023'56"
West along said east line, a distance of 282.27 feet to the point of
beginning. Contains 95,214 square feet or 2.185 acres, more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer extend water mains as required by the Water Services Department.
5. That
the developer provide for fire protection as required by the Fire Department.
6. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots. A copy of the street tree planting plan
shall be submitted to the Department of City Development. The plan shall
include size, type, species and placement of trees.
7. That
the developer contribute $2,382.00 in lieu of parkland dedication for 10 single
family lots in satisfaction of Section 66-128 of the Subdivision Regulations.
8. That
the developer secure the approval of the Street Naming Committee for all street
names prior to the submittal of the first final plat.
9. That
the developer extend the covenants, conditions and restrictions as required by
the Department of Public Works.
A copy of the preliminary plat is on file in the
office of the City Clerk under Document No. 981416, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed preliminary plat
hereinabove, all public notices and hearings required by the Subdivision
Regulations have been given and had.
