COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 191048, AS AMENDED

 

Establishing further terms by which the Mayor and Councilmembers shall jointly review and interview candidates for City Manager.

WHEREAS, Section 218(a) of the Kansas City Missouri Charter states as follows: “The Mayor and Council shall jointly conduct a search or recruitment for a City Manager upon terms agreed upon by the Mayor and Council. Upon completion of this process the Mayor shall be responsible for submitting a resolution to the Council for the appointment of a City Manager. If an appointment is not approved, the Mayor may submit another person for consideration, or may ask that a search or recruitment process begin anew;” and

 

WHEREAS, Resolution 190885, adopted unanimously by Council on October 17, 2019, directed the City Manager to retain a national search firm to assist in the selection of a new City Manager; and

 

WHEREAS, pursuant to Resolution 190885 and prior direction, the City Manager has identified and is engaging in final contracting with the Chicago-based national executive search firm, Baker Tilly Virchow Krause, LLP, to assist the City in the City Manager search; and

 

WHEREAS, best practices and fairness dictate that the search firm shall conduct a comprehensive search to ensure the response of high-quality applicants for Council and Mayor review; and

 

WHEREAS, in order to ensure the highest volume of quality applicants, confidentiality often must be maintained until the designation of final candidates; and

 

WHEREAS, the Mayor seeks the involvement of Council prior to his Charter-mandated submission of a final candidate to Council; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Mayor and Councilmembers establish further terms by which the Mayor and Councilmembers shall jointly review and interview candidates for City Manager as follows:

 

1.                  The City-identified executive search firm, Baker Tilly Virchow Krause, LLP, (the “search firm”), shall facilitate for the City the search for the City Manager;

 

2.                  Upon the commencement of its engagement with the City, the search firm shall interview the Mayor and all councilmembers to ascertain the qualifications and attributes that each is seeking in a City Manager;

 

3.                  The search firm shall, to the extent practicable, also meet with community parties as recommended by Mayor and individual Councilmembers;

 

4.                  The search firm shall use its best efforts in conducting a nationwide search for a City Manager, in accordance with all applicable professional standards and City, state, and federal laws and policies;

 

5.                  The search firm shall, to the extent legally permitted, endeavor to obtain applicants from a diverse set of backgrounds;

 

6.                  With the exception of providing technical assistance, upon request by the search firm, or providing references or information, as requested, no person employed by another branch of local, state, or national government may participate in the recruitment and selection process in any manner other than serving as an applicant for the City Manager position;

 

7.                  In a manner consistent with professional standards, subject to procedures to ensure confidentiality in non-final phases of the search, and as directed by the search firm, the Mayor and each councilmember shall have access to all applications and materials submitted in connection with the search;

 

8.                  Upon completion of its review of applicants, and in a manner consistent with professional standards and subject to procedures to ensure confidentiality in non-final phases of the search, the search firm shall return to the Mayor and each councilmember a recommendation of not more than twenty-five (25) applicants it recommends for further review;

 

9.                  In a manner consistent with professional standards and subject to procedures to ensure confidentiality in non-final phases of the search, each councilmember and the Mayor may add one applicant who originally applied and was included in the vetting process to the twenty-five (25) applicants selected by the search firm for further review;

 

10.              Drawing from the list of applicants for further review, each councilmember and the Mayor shall, if he or she wishes, recommend to the Committee of the Whole not more than three applicants for final interviews;

 

11.              Based on the recommendations from each councilmember and the Mayor, the Committee of the Whole shall invite not less than three and not more than five applicants for final interviews before the full Council;

 

12.              Upon completion of interviews, the Mayor shall receive recommendations from each councilmember as to preferred applicants.

 

In accordance with the Charter, the Mayor shall be responsible for submitting a resolution to the Council for the appointment of a City Manager.
