ORDINANCE NO. 050801

 

Approving the preliminary plat of Walnut Corner Condominiums I on a 0.53 acre tract of land generally located at the northwest corner of 50th Street and Walnut Street. (SD 1154)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Walnut Corner Condominiums I on a 0.53 acre tract of land generally located at the northwest corner of 50th Street and Walnut Street, and more specifically described as follows:

 

TRACT I: The East 60 feet of the South 72.75 feet of Lot 24, Block 1, BISMARK PLACE, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT II: The South 33 feet of Lot 21 and the North 35 feet of Lot 22, Block 1, BISMARK PLACE, a subdivision in Kansas City, Jackson County, Missouri.

 

TRACT III: The South 15 feet of Lot 22, all of Lot 23, and the North 3 feet of Lot 24, Block 1, BISMARK PLACE, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by Development Services in accordance with Chapters 56 and 64, Code of Ordinances, prior to recording of the plat.

 

3.      That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space tracts.

 

4. That the developer submit an indemnification agreement to the Water Services Department for the structures located on the existing sanitary sewer easement and submit a copy of the agreement to the Department of City Development prior to the ordinance request.

 

5. That the developer receive the approval of the Board of Zoning Adjustment for any required variances.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
