ORDINANCE NO. 910623

 

Amending Article IX, Division 6 of the Kansas City Administrative Code pertaining to Workers' Compensation by repealing Section A9.113 pertaining to Supplemental Compensation and Continuance of Salary for Temporary Disability and enacting in lieu thereof one new section of like number.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Article IX, Division 6 of the Kansas City Administrative Code is hereby amended by repealing Section A9.113 thereof and enacting in lieu of said section, one new section of like number to read as follows:

 

Section A9.113. Payments during Temporary Disability.

 

(a) When an employee is absent from duty and unable to perform the duties of his/her employment with the City because of an injury sustained arising out of and in the course of employment, such employee shall be paid compensation for that period of temporary total disability, as provided under the Missouri Workers' Compensation Law, which payments shall be subject to the right of subrogation provided under Section 287.150, Revised Statutes of Missouri, as amended, and the credit provided under Section 287.100, Revised Statutes of Missouri.

 

(b) A member of the fire fighting force receiving compensation for temporary total disability under Subsection (a) of Section A9.113 may elect to enter into an agreement with the City which will permit such employee to receive supplemental payments up to his full wages during the period of temporary total disability in addition to that compensation provided by law. Such supplemental wages shall be treated by said agreement as an advance of any additional benefits the employee may be entitled to receive as a result of the injury, and the City will be entitled to take credit for the same against said additional benefits.
