ORDINANCE NO. 051154

 

Approving the plat of Brentwood Crossing First Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways, authorizing the Director of Public Works to execute certain agreements; authorizing the Director of Public Works to accept a Partial Deed of Release and authorizing the City Clerk to file this ordinance and attached agreement.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Brentwood Crossing First Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

Section 4. That various easements in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument number, and respective book and page numbers are hereby accepted for the purposes stated thereof:

1.      Two Temporary Construction Easements from Trophy Homes, Inc. a Missouri Corporation:

 

Instrument No. 2005011135, Book No. 4935, and Page No. 30

Instrument No. 2005011136, Book No. 4935, and Page No. 31

 

2.      Standard Sewer Easement from Trophy Homes, Inc. a Missouri Corporation, Instrument No. 2005011139, Book No. 4935, and Page No. 34

 

3.      Two Storm Drainage Easements from Trophy Homes, Inc. a Missouri Corporation:

 

Instrument No. 200501137, Book No. 4935, and Page No. 32

Instrument No. 200501138, Book No. 4935, and Page No. 33

 

Section 5. That all right, title and interest in a sanitary sewer easement accepted by Kansas City, under Document P31855, Book 2951, Page 645, be and the same is hereby released to the respective owner, their successors or assigns, over that part of aforesaid easement described as follows:

 

A strip of land 15.00 feet in width in the Northwest Quarter and the Northeast Quarter of Section 35, Township 52 North, Range 32 West, Kansas City, Clay County, Missouri lying 7.50 feet on each side of the following described centerline: Commencing at the Northwest corner of said Northwest Quarter; thence South 893247 East, along the North line of said Northwest Quarter, 398.59 feet; thence South 271631 West, 55.80 feet; thence South 322309 East, 304.39 feet; thence South 561846 East, 545.01 feet; thence South 285623 East, 198.13 feet to the True Point of Beginning of the portion of the above referenced Sanitary Sewer Easement to be released; thence South 665531 East, 222.18 feet; thence South 482602 East, 309.34 feet; thence South 603946 East, 335.71 feet; thence South 431911 East, 345.87 feet; thence South 733848 East, 175.97 feet; thence South 572458 East, 20.47 feet to the Point of Termination.

 

Section 6. That the Director of Public Works is hereby authorized to execute a Covenant to Maintain Stormwater Detention Facility Agreement, to be in a form substantially as that attached hereto as Exhibit "A" and incorporated herein by reference.

 

Section 7. That the Director of Public Works is hereby authorized to accept a Partial Deed of Release to be in a form substantially as that attached hereto as Exhibit "B" and incorporated herein by reference.

 

Section 8. That the City Clerk is hereby directed to file copies of this ordinance, together with the Covenant to Maintain Stormwater Detention Facility Agreement and the Partial Deed of Release, in the Office of the Secretary of State of Missouri and in the Office of the Recorder of Deeds of Clay County, Missouri together with all other relevant documents.

 

Section 9. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
