RESOLUTION NO. 051301

 

Approving an amendment to the Town Fork Creek Area Plan by modifying the Land Use Plan and Map in the area bounded by Brush Creek on the north, Prospect Avenue on the west, 63rd Street on the south and Swope Parkway/Cleveland Avenue on the east to be consistent with the Town Fork Creek Neighborhood Plan. (227-S-10)

 

WHEREAS, on March 10, 1978, the City Council by Resolution No. 48787 adopted the Town Fork Creek Area Plan as a guide for development and redevelopment of that area generally located between the Blue Parkway and 63rd Street and between Prospect and the Big Blue River; and

WHEREAS, said Town Fork Creek Area Plan was amended on November 30, 1989, through the adoption of Resolution No. 64741; was amended on March 26, 1992, through the adoption of Resolution No. 920131; was amended on June 30, 1994, through the adoption of Resolution No. 940642; was amended on December 20, 2001, through the adoption of Resolution No. 011677; was amended on June 6, 2002, through the adoption of Resolution No. 020585; and was further amended on November 7, 2002 through the adoption of Resolution No. 021246; and was further amended on February 26, 2004 through the adoption of Resolution No. 040141; and

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Town Fork Creek Area Plan as it affects the area bounded by Brush Creek on the north, Prospect Avenue on the west, 63rd Street on the south and Swope Parkway/Cleveland Avenue on the east, by modifying the Proposed Land Use Plan and Map for such area to be consistent with the Town Fork Creek Neighborhood Plan, and

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on October 4, 2005; and

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on October 4, 2005, recommend approval of the proposed amendment to the Town Fork Creek Area Plan; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That an amendment to the Town Fork Creek Area Plan is hereby approved for that area bounded by Brush Creek on the north, Prospect Avenue on the west, 63rd Street on the south and Swope Parkway/Cleveland Avenue on the east, by modifying the Proposed Land Use Plan and Map for such area to be consistent with the Town Fork Creek Neighborhood Plan. A copy of the amendment to the Land Use Plan and Map of the Town Fork Creek Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Town Fork Creek Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
