SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060990

 

Expressing support for the expenditure of $2.7 million in sales tax funds to rebuild certain roadways in the vicinity of the Police Academy and the Southeast Community Center and the repayment of $153,040.00 to Maplewoods Parkway; appropriating $4,293,040.00 to the Police Academy Roadways, Maplewoods Parkway, Police Academy and Southeast Community Centers accounts in the Capital Improvements Sales Tax Fund; directing the Public Improvements Advisory Committee to include an allocation of $4,293,040.00 in next years Capital Improvements Sales Tax City-wide Program; directing the City Manager to identify funds to cover any shortfall in next years Capital Improvements Sales Tax City-wide Program resulting from this appropriation; and designating requisitioning authority.

 

WHEREAS, the Council has expressed its support in Resolution No. 050924 for the development of a financing plan in an amount not to exceed $10,000,000.00 for the purpose of constructing and reconstructing Shoal Creek Parkway, Searcy Creek Parkway, and Pleasant Valley Road and all related infrastructure for the purpose of facilitating the construction of the Kansas City Police Academy and directed the City Manager to develop a financing plan that allows the City to construct the necessary improvements to coincide with the construction of the academy; and

 

WHEREAS, the Council has determined that it would be prudent to address this safety need for infrastructure immediately by appropriating funds to address a portion of the infrastructure needs; and

WHEREAS, that the Council hereby supports the expenditure of $2.7 million for the rebuilding of certain roadways in the vicinity of the Police Academy; and

 

WHEREAS, that the Council hereby supports the expenditure of $440,000.00 for the repayment of the Police Academy account for burying overhead power lines by KCP&L; and

 

WHEREAS, that the Council hereby supports the expenditure of $153,040.00 for repayment of Maplewoods Parkway dollars used to help complete design for Shoal Creek Parkway, Searcy Creek Parkway, and Pleasant Valley Road; and

 

WHEREAS, the Council also supports the completion of the Southeast Community Center in the amount of $1 million; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:


Section 1. That the sum of $4,293,040.00 is hereby appropriated from the Unappropriated Fund Balance of Capital Improvements Sales Tax Fund to the following accounts:

 

07-3090-708709-B Academy Roadways $2,700,000.00

07-3090-707220-B Maplewoods Parkway 153,040.00

07-3090-898827-B Police Academy 440,000.00

07-3090-707567-B Southeast Community Center 1,000,000.00

TOTAL $4,293,040.00

Section 2. That the City Council hereby directs the Public Improvement Advisory Committee (PIAC) to include an allocation of $4,293,040.00 in the FY 2007-08 Capital Improvements Sales Tax Citywide Program to repay this appropriation.

 

Section 3. That the Director of Parks and Recreation is hereby designated as requisitioning authority for Account Nos. 07-3090-708709, 07-3090-707220 and 07-3090-707567-B and the City Manager is hereby designated as requisitioning authority for Account No. 07-3090-898827.

 

Section 4. That, in the event that the 2007-08 Budget does not reflect adequate funds to cover the expenditure of $4,293,040.00 without reductions in other city-wide projects approved by the Council in the Five Year Capital Improvements Plan, the City Manager is directed to identify funds from sources other than the Citywide PIAC account to cover amount of the shortfall.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
