ORDINANCE NO. 970570

 

Approving an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately an 11.3 acre tract of land generally located at the southwest corner of Vivion Road and N. Oak Trafficway. (2718-CP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately an 11.3 acre tract of land generally located at the southwest corner of Vivion Road and N. Oak Trafficway, and more specifically described as follows:

 

This is a resurvey and subdivision of portions of Lots 9, 10, 11 and 12, Block 6, all or portions of Lots 6 to 15, inclusive, Block 7, and a portion of Meadow Lane between said Block 5 and 6, all in Green Meadows, a subdivision in Clay County, Missouri, according to the recorded plat thereof, and all now vacated, all more particularly described as follows: All that part of the East Half (E 1/2) of the Northwest Quarter (NW 1/4) of Section 2, Township 50, Range 33, in Kansas City, Clay County, Missouri, described as follows: Commencing at a point on the east line of said 1/2-1/4 Section 475.30 feet south of the northeast corner thereof; thence west along a line that makes a southwest angle of 90 03'30" with said east line, 84.65 feet to a point on the west line of Oak Street Trafficway, as now established, and the point of beginning of the tract of land to be herein described; thence continuing west along the last described course 100 feet; thence South 70 42'40" West 105.95 feet; thence west 500 feet; thence North 78 22' West 45.37 feet; thence northwesterly along a curve to the right, having a radius of 532.96 feet, the initial tangent of which bears North 85 16' West, 233.16 feet; thence North 45 27'37" West 47.13 feet; thence northwesterly along a curve to the right, having a radius of 522.96 feet, and being concentric with the last described curve, 45.64 feet; thence North 59 56'27" West, 47.13 feet; thence northwesterly, along a curve to the right, having a radius of 332.96 feet and being concentric with the last described curve, 243.46 feet to a point 25 feet east of the west line of said 1/2-1/4 Section; thence North 0 15'30" West, parallel with said west line, 26.25 feet to a point on the southerly line of Vivion Road, as now established; thence North 79 14'30" East along said southerly line, 68.36 feet; thence northeasterly and easterly along said southerly line, being a curve to the right from the last described course as a tangent, having a radius of 3779.72 feet, a distance of 722.36 feet to a point 40 feet south of the north line of said 1/2-1/4 Section; thence South 89 48'30" East, parallel with said north line and along the southerly line of said Vivion Road, 202.86 feet; thence South 46 36'15" East, 14.70 feet; thence South 89 48'30" East along said southerly line 168.10 feet; thence South 43 21'50" East, along said southerly line, 88.93 feet to a point on the west line of said Oak Street Trafficway; thence south along said west line, 246.04 feet; thence South 11 38'40" West 117.42 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer provide cross access easements with the final plat as required by the Department of Public Works.

 

3. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any necessary improvements as required by the

City Engineer's Office.

 

4. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

5. That the developer install sidewalks, curbs and gutters on the south side of N.E. Vivion Road and on the west side of N. Oak Trafficway as required by the

Department of Public Works.

 

6. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

7. That the developer modify the N.E. Vivion Road entrance median as required by the Department of Public Works.

 

8. That the developer pave all parking surfaces as indicated on the attached preliminary plan prior to the issuance of a certificate of occupancy.

 

9. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping both on-site and within the State right of way.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970570, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
