ORDINANCE NO. 050800

 

Approving a Community Unit Project on an approximately 1.27 acre tract of land generally located on the south side of 46th Street between Jarboe Street and Holly Street. (13368-CUP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 1.27 acre tract of land generally located on the south side of 46th Street between Jarboe Street and Holly Street, and more specifically described as follows:

 

Lots 1 to 7, inclusive, Lot 8 except the South 5 feet thereof, and all of the vacated alley lying East of and adjoining the aforesaid premises, Lot 41, except the South 5 feet thereof, and Lots 42 to 48, inclusive, Block 13, BUNKER HILL, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Together with a non-exclusive easement for vehicular ingress and egress for the purpose of vehicular parking, as established by that certain Easement Agreement filed for record June 17, 1993 as Document No. K-1085426 in Book K-2405 at Page 2394, as amended by the instrument filed December 21, 1995 as Document No. K-1226034 in Book K-2779 at Page 1738 and as further amended by the instrument filed for record June 10, 1998 as Document No. 98-K-30605 in Book K-3213 at Page 2204.

 

Also described as: Beginning at the Northeast corner of Lot 48, Block 13, BUNKER HILL, a subdivision in Kansas City, Jackson County, Missouri, being the intersection of the South line of 46th Street (50r/w) and the West line of Jarboe Street (50r/w); thence S 23049W along said West line for 200.00 feet to a point 5.00 feet North of the Southeast corner of Lot 41, Block 13, BUNKER HILL; thence N 872121W parallel to the South line of Lots 41 and 8 to the East line of Holly Street (50r/w); thence N 23118E along said East line for 200.00 feet to the Northwest corner of Lot 1, Block 13, BUNKER HILL; thence S 872121E along the South line of 46th Street (50r/w) for 275.57 feet to the Point of Beginning. Containing 1.265 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.


2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Department of Public Works in accordance with Chapters 56 and 64, Code of Ordinances, prior to recording of the plat.

 

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space tracts.

 

4.                  That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

5. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
