RESOLUTION NO. 900717

 

Agreeing that the City will fulfill the remainder of Martin Luther King, Jr. Memorial Hospital's eligible use, community services and uncompensated services obligations from its Federal Hill-Burton project grant through the facilities of Truman Medical Center.

WHEREAS, Martin Luther King, Jr. Memorial Hospital was constructed partially with Hill-Burton project grant funds obtained by the Greater Kansas City Baptist and Community Hospital, Inc. under Title VI of the U.S. Public Health Service Act; and

 

WHEREAS, the hospital facility was subsequently closed pursuant to a filing in bankruptcy leaving a remaining unfulfilled obligation of eligible use, community services, and uncompensated services under that Act; and

 

WHEREAS, the City has obtained effective control of the hospital building and property with the intent to encourage redevelopment of the facility into a residential complex for the elderly and has requested a waiver of the Federal government's right to recover funds therefrom in accordance with Section 609 of the U.S. Public Health Service Act based upon the assumption and transfer of the remainder of the facility's Hill-Burton eligible use, community services and uncompensated services obligations to Truman Medical Center, an eligible facility, which is partially supported by substantial funding from the City; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the Mayor and Council hereby agree that the City will fulfill the remainder of Martin Luther King, Jr. Memorial Hospital's Hill-Burton eligible use, community services and uncompensated services obligations at Truman Medical Center; and

 

BE IT FURTHER RESOLVED, that the City Manager is hereby directed and authorized to enter into any necessary agreements with the United States Department of Health & Human Services and Truman Medical Center to effectuate the fulfillment of that obligation and to facilitate the requested waiver of the Federal government's right to recover funds under the Act; and

 

BE IT FURTHER RESOLVED, that this Resolution be spread upon the Minutes of the Council in testimony thereof and that copies hereof be provided to the appropriate departments and agencies of the Federal government as evidence of the City's acceptance of this obligation and promise of fulfillment.
