RESOLUTION NO. 910427

 

Instructing the City Manager to implement a disparity study on the utilization of MBE's and WBE's in light of the recent U.S. Supreme Court case of City of Richmond v. J.A. Croson Company.

WHEREAS, the Supreme Court of the United States in the case of City of Richmond v. J.A. Croson Company, determined that municipal governments must validate the need to implement race and/or gender specific remedial affirmative action programs; and

 

WHEREAS, the City Council expresses its intent to conduct a study to validate whether there is a need to implement race and/or gender specific remedial affirmative action programs to assist Minority and Women's Business Enterprises and prevent the City from being either an active or passive participant in racial and/or gender determination; and

 

WHEREAS, the study will assess the extent of utilization and availability of MBE's and WBE's as prime contractors and subcontractors by the City and other public and private entities; and

 

WHEREAS, the study will also investigate prevailing practices in the public and private sectors that have caused any under utilization of MBE's and WBE's; and

 

WHEREAS, the study will also document the extent to which the current availability of MBE's and WBE's may itself reflect past and/or present discrimination; and

 

WHEREAS, the study will also determine the best methods to remedy any present or past discriminatory effects as provided for by the United States Supreme Court in its ruling in City of Richmond v. J.A. Croson Company; and

 

WHEREAS, the City will be seeking bids from firms or entities qualified to conduct the aforementioned study; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the City Council instructs the City Manager to develop all necessary means to implement the aforementioned disparity study and contract with the necessary firms or entities to conduct the study.
