RESOLUTION NO. 081140

 

Amending the Town Fork Creek Area Plan, by changing the recommended land use on about 1.79 acres generally located at the northeast corner of 60th Street and Swope Parkway from public/semi-public to medium density residential. (227-S-11)

WHEREAS, the Council adopted the Town Fork Creek Area Plan through the passage of Resolution No. 48787, passed March 10, 1978, as a guide for development within the Town Fork Creek Area being that part of Kansas City, Missouri, bounded on the north by 47th Street and Blue Parkway, on the south by 63rd Street, on the east by the Big Blue River and on the west by Prospect Avenue; and

WHEREAS, said Town Fork Creek Area Plan was amended on November 30, 1989, through the adoption of Resolution No. 64741; was amended on March 26, 1992, through the adoption of Resolution No. 920131; was amended on June 30, 1994, through the adoption of Resolution No. 940642; was amended on December 20, 2001, through the adoption of Resolution No. 011677; was amended on June 6, 2002, through the adoption of Resolution No. 020585; was amended on November 7, 2002 through the adoption of Resolution No. 021246; was amended on February 26, 2004 through the adoption of Resolution No. 040141; and was further amended on November 17, 2005, through the adoption of Resolution No. 051301; and

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Town Fork Creek Area Plan as it affects the area generally located at the northeast corner of 60th Street and Swope Parkway from public/semi-public to medium density residential; and

WHEREAS, legal notice of the public hearing before the City Plan Commission was published in conformity with state and local laws; and

WHEREAS, the City Plan Commission did hold public hearings and did recommend approval on October 7, 2008, of the amendment to the Town Fork Creek Area Plan and to the land uses, guidelines and standards contained in said amendment; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to the Town Fork Creek Area Plan is hereby approved for that area generally located at the northeast corner of 60th Street and Swope Parkway by modifying the Proposed Land Use Plan and Map from public/semi-public to medium density residential. A copy of the amendment to the Land Use Plan and Map of the Town Fork Creek Area Plan is attached hereto as Exhibit A and incorporated herein by reference.


Section B. That the amendment to the Town Fork Creek Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
