ORDINANCE NO. 970528

 

Approving the plat of Willow Park 2nd Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Willow Park 2nd Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

 

Section 4. That all right, title and interest in a temporary roadway easement as recorded under Document No. N17315, Book 2610, page 338 on October 8, 1996, be and the same is hereby released to the respective owner, their successors or assigns, over that part of aforesaid easement described as follows:

 

All that part of the Northwest Quarter of Section 36, Township 52, Range 33 in the City of Kansas City, Clay County, Missouri, described as follows: Commencing at the most northwesterly corner of Tract AP-2, New Mark, a subdivision of land in the City of Kansas City, Clay County, Missouri; thence southerly along the northerly right of way line of N.E. New Mark Drive along a curve to the right, having an initial tangent bearing of South 71 29'42" East and a radius of 899.44 feet, an arc distance of 576.63 feet; thence North 64 11'30" East, a distance of 261.09 feet; thence South 31 46'51" East, a distance of 33.93 feet; thence North 40 56'30" East, a distance of 131.57 feet; thence North 49 03'30" West, a distance of 11.67 feet; thence North 40 56'30" East, a distance of 170.00 feet to the southerly line of Tract "D", Fox Hill Fourth Plat, a subdivision of land in Kansas City, Clay County, Missouri; thence South 49 03'30" East along the southerly line of said Tract "D", a distance of 196.67 feet; thence South 41 57'20" East along the southerly line of said Tract "D" and its southeasterly prolongation thereof, a distance of 449.88 feet; thence South 51 41'32" West, a distance of 85.66 feet to the point of beginning of the tract of land herein to be described; thence southeasterly along a curve to the right, having an initial tangent bearing of South 38 18'28" East and a radius of 240.00 feet, an arc distance of 110.98 feet; thence South 78 11'15" West, a distance of 110.00 feet; thence northwesterly along a curve to the left, having an initial tangent bearing of North 11 48'45" West, a radius of 130.00 feet, an arc distance of 68.39 feet; thence North 41 57'20" West, a distance of 14.60 feet; thence North 48 02'40" East, a distance of 30.00 feet; thence South 41 57'20" East, a distance of 14.60 feet; thence southeasterly along a curve to the right being tangent to the last described course and having a radius of 160.00 feet and an arc distance of 10.19 feet; thence North 51 41'32" East, a distance of 80.00 feet to the point of beginning.

 

Section 5. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
