ORDINANCE

Approving a petition to add real
property to the Kansas City International Airport Community Improvement
District, and authorizing the City Manager to execute an amendment to a
cooperative agreement with the District for the purpose of funding public
infrastructure improvements.
WHEREAS, the Kanas
City International Airport Community Improvement District (the “District”) was
established by Ordinance No. 050203 for a period of thirty years effective
March 20, 2005; and
WHEREAS,
on or about August 1, 2005, the City and the District executed a cooperative
agreement whereby the parties agreed to use a portion of the one percent
(1.00%) sales tax imposed by the District to fund the repairs, improvements and
rehabilitations of the Overhaul Base located at the Kansas City International
Airport; and
WHEREAS,
the City desires that the District expand its current boundaries to include
additional property owned by the City and abutting the District; and
WHEREAS,
the City and District desire to simultaneously amend their cooperative
agreement to further enhance the potential for growth and development of an
area within a portion of the boundaries of the District by allocating certain
tax revenues generated within a portion of the District to fund various public
infrastructure improvements; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That
the petition to add real property to the Kansas City International Airport
Community Improvement District, previously established as a political
subdivision pursuant to Ordinance No. 050203 and in accordance with Section
67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri
Community Improvement District Act (the “Act”), is hereby approved in its entirety.
Section 2. That the
District shall continue to have all the powers and authority authorized by the
petitions to establish the District and to add real property, the Act, and by
law, and shall continue to exist and function for thirty (30) years following
the effective date of Ordinance 050203.
Section 3. That
the District shall annually submit its proposed budget, report and copies of
written resolutions passed by the District’s board to the City pursuant to
Section 67.1471, RSMo.
Section 4. That
the City Manager is authorized to execute a second amendment to that certain
cooperative agreement between District and City dated August 1, 2005, as
previously amended by that certain first amendment dated September 20, 2010,
whereby the City will commit a defined portion of the tax revenues generated
within a defined area of the District for the purpose of funding public
infrastructure improvements located within the boundaries of the District as
herein expanded. The amendment is approved in substantial form as attached
hereto.
