ORDINANCE NO. 900425

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2338, rezoning an area generally bounded by Cliff Drive, St. John Avenue, Wabash Avenue, Lexington Avenue, Chestnut Avenue, north of Independence Boulevard, east of Maple Boulevard/Avenue and south of Pendleton Avenue from District R-4 (low apartment) to District R-2b (Two-Family Dwelling). BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2338, rezoning an area generally bounded by Cliff Drive, St. John Avenue, Wabash Avenue, Lexington Avenue, Chestnut Avenue, north of Independence Boulevard, east of Maple Boulevard/Avenue and south of Pendleton Avenue from District R-4 (low apartment) to District R-2b (two-family dwelling), said section to read as follows:

 

Section 65.010A2338. That an area legally described as:

 

Beginning at the Northwest corner of Lot 11, Trosts 3rd Addition, thence West parallel to the South line of Pendleton Avenue as now established to a point 30 feet West of the Southwest corner of Lot 9, Garfield Square, thence South parallel to the West line of said Lot 9 a distance of 7 feet thence West parallel to the South line of Pendleton Avenue as now established a distance of 429 feet to the West line of Woodland Avenue as now established thence South along a prolongation of said West line of Woodland Avenue as now established a distance of 25 feet thence West 66.90 feet thence Northwesterly along the Southwestern boundary of part of Lot 2 Bouton Park to a point on the West line of the NW 1/4 of the Southeast 1/4 Section 33-50-33. Thence North along said 1/4 1/4 section line a distance of 93 feet + thence Northeasterly along the Southeasterly line of North Terrace Park (now known as Kessler Park.) To a point on the North of said 1/4 1/4 Section. Thence East along said 1/4 1/4 section line to its intersection with the East line of Garfield Avenue as now established. Thence North a distance of 25 feet along said East line thence East a distance of 175.66 feet parallel to the North line of the South East 1/4 Section 33-50-33. Thence South a distance of 50 feet parallel to the East line of Garfield Place as now established. Thence East along the South line of St. John Avenue as now established to the West line of Wabash Avenue as now established. Thence South along said West line to its intersection with the South line of Lexington Avenue as
now established. Thence East along said South line to its intersection with the Northeast corner of Lot 24 Holyrood. Thence South to the Northeast corner of Lot 13 Oak Grove Addition. Thence Southeasterly and Southerly along the East line of said Lot 13 to the Northeast corner of Lot 12 Oak Grove Addition. Thence South to the Southeast corner of Lot 7 Block 1 Richmond Place. Thence West a distance of 150 feet to the Southwest corner of said Lot 7 thence West a distance of 50 feet to the southeast corner of Lot 5 Independence Avenue Addition. Thence South a distance of 15 feet to the Northeast corner of Lot 4 Independence Avenue Addition. Thence West to the Northwest corner of said Lot 4 thence South a distance of 50 feet to the Southwest corner of said Lot 4. Thence West parallel to the North line of Independence Boulevard as now established to a point on the West line of the North/South alley running between Prospect Avenue as now established and Wabash Avenue as now established. Thence North on the west line of said alley to its intersection with the South line of the East/West alley running between Amie Street as now established and Independence Boulevard as now established. Thence West following the South line of said E/W alley a distance of 105.94 feet. Thence South and parallel to the East line of Wabash Avenue as now established a distance of 225.0 feet. Thence West and parallel to Independence Boulevard as now established a distance of 183.56 feet to the east line of Wabash Avenue as now established. Thence South on said East line to a point which is a distance of 130 feet North of the North line of Independence Boulevard as now established. Thence west to a point on the West line of Olive Street as now established said point being a distance of 130 feet North of the North line of Independence Boulevard as now established. Thence North to a point on said West line of Olive Street as now established which is 188 feet North of the North line of Independence Boulevard as now established. Thence West to the West line of Park Avenue as now established. Thence North to a point on said West line which is 215 feet North of the North line of Independence Boulevard as now established. Thence West to a point on the West line of the N/S alley running between Brooklyn as now established and Park as now established. Thence North to a point on the West line of said N/S alley this point being 16 feet North of the Southeast corner of Lot 19 Forest Home. Thence West to the East line of Brooklyn Avenue as now established. Thence South on said East line a distance of 250.3 feet. Thence West to the West line of Garfield Avenue as now established. Thence West and parallel to the North line of Independence Boulevard as now established a distance of 185 feet. Thence North and parallel to the West line of Garfield Avenue as now established a distance of 359.5 feet. Thence East and parallel to the South line of Missouri Avenue as now established a distance of 52 feet +. Thence North and parallel to the West line of Garfield Avenue as now established to the Northeast corner of Lot 5, Block 1, Phelps Place. Thence West to the Northeast corner of Lot 7, Block 1, Phelps Place. Thence North to the Northwest corner of Lot 7 Garfield Summit. Thence East to the Northwest corner of Lot 4 Mathew and Hills Addition. Thence South to the Southwest corner of Lot 1 Mathew and Hills Addition, said point being also on the North line of Minnie Street as now established. Thence East following the North line of Minnie Street as now established to a point which is 4.68 feet West of the Southwest corner of Lot 11 Lexington Place thence North and parallel to said lot line to a point which is 4.68 feet West of the Southwest corner of Lot 5 Lexington Place. Thence East to the Southeast corner of Lot 6 Lexington Place. Thence South to a point which is 5 + feet North of the Southwest corner of Lot 8 Lexington Place. Thence East a distance of 80 feet to the Northeast corner of said Lot 8. Thence Northeasterly to a point on the East line of Ord Street as now established which is 6.5 feet South of the North line of Lot 15 Block 2 Mathews and Hills Addition. Thence East along said line to a point on the West line of Park Avenue as now established. Thence continuing East to a point on the East line of Park Avenue as now established said point being 80.0 feet North of the North line of Minnie Street as now established. Thence continuing East along said line 71.77 feet to the Northeast corner of Lot 19 Mathews and Hills Addition thence South to the Northwest corner of Lot 9 Mathews and Hills Addition. Thence East along said lot line and its prolongation to a point on the East line of Olive Street as now established which is the Northwest corner of Lot 16 Resurvey of Pendleton Heights. Thence South a distance of 25 feet to the Southwest corner of said Lot 16 thence East along the South line of said Lot 16 to the West line of the North/South alley running between Olive as now established and Wabash Streets as now established. Thence North along West line of said alley to the Northeast corner of Lot 31 Block 5 Resurvey of Pendleton Heights. Thence West along the North line of said Lot 31 and its prolongation to the Northwest corner of Lot 2 Block 12 Resurvey of Pendleton Heights. Point also lying on the East line of North/South alley running between Garfield as now established and Brooklyn Avenues as now established. Thence North along said East alley line to the Northwest corner of Lot 6 Block 12 Resurvey of Pendleton Heights. Thence West a distance of 14 feet to the Northeast corner of Lot 27 Block 12 Resurvey of Pendleton Heights. Thence West along North line of said Lot 27 to the East line of Garfield Avenue as now established. Thence North along said East line to the Northwest corner of Lot 19 Block 12 Resurvey of Pendleton Heights. Thence West a distance of 60 feet to a point on the West line of Garfield Avenue as now established said point also being the Northeast corner of Lot 12 Trosts 3rd Addition. Thence West a distance of 195.66 feet to the Northwest corner of said Lot 12. Thence North a distance of 50 feet to the point of beginning, all lying within Kansas City, Jackson County, Missouri.

 

 

is hereby rezoned from District R-4 (low apartment) to District R-2b (two-family dwelling), all as shown outlined on a map marked Section 65.010A2338, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
