COMMITTEE SUBSTITUTE
FOR RESOLUTION NO. 180782
Directing the City Manager to create a
Local Business Enterprise Program to assist those firms who qualify for the
MBE/WBE Program but have exceeded the size standards and personal net worth
limits to be considered a small business by providing business development
support; and to convene a committee to make recommendations for the
implementation of the program.
WHEREAS, the City
recognizes that socially and economically disadvantaged firms continue to
experience disparate treatment based on race and/or sex after graduating from
the City’s MBE/WBE program; and
WHEREAS, the City desires
to remediate this disparate treatment by ensuring that those local firms that
have previously met the criteria for certification as a Minority or Woman Owned
Business, but have exceeded the SBA size standards and personal net worth
standards, continue to have non-discriminatory access to city-funded and/or
incentivized contracts; and
WHEREAS, the City desires
to ensure that local firms have the ability to compete in the local market for
city-funded or incentivized contracts; and
WHEREAS, the City desires
that a Local Business Enterprise Program for assisting socially and
economically disadvantaged entrepreneurs and local contractors gain access to opportunities
within the local economy; NOW, THEREFORE:
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the City
Manager is hereby directed to create a Local Business Enterprise Program within
60 days which shall assist local firms and business who have graduated from the
City’s MBE/WBE program by providing business development and support. The focus
of the program shall provide business development support including increased
participation on certain City and Agency contracts by implementing a goal
program separate and distinct from the MBE/WBE goals; Procurement assistance; Scale-up
Training; and increased surety bonding; and other management and technical
assistance.
Section 2. That the City
Manager is hereby directed to appoint a committee to make recommendations for
the implementation of the Local Business Enterprise Program inclusive of, but
not limited to, the following members:
(1)
One member and one alternate recommended by the Builder’s Association;
and
(2)
One member and one alternate recommended by the Heavy Constructors’
Association; and
(3)
One member and one alternate recommended by the Minority Contractors’
Association of Kansas City; and
(4)
One member and one alternate recommended by the Kansas City Hispanic
Association of Kansas City; and
(5)
One member and one alternate recommended by the Hispanic Contractors
Association of Greater Kansas City; and
(6)
One member and one alternate recommended by the National Association of
Women in Construction: and
(7)
One member and one alternate recommended by the Women Construction
Owners and Executives; and
(8)
One member and one alternate recommended by Black Chamber of Commerce of
Greater Kansas City; and
(9)
Two members and two alternates recommended by Human Relations
Department.
(10)
One at-large member recommended by the City Manager or his designee.
