ORDINANCE NO. 970527

 

Approving the plat of Line Creek Meadows-Second Plat, an addition in Kansas City, Platte County, Missouri; accepting various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City; authorizing the Director of Public Works to execute certain agreements, and authorizing the City Clerk to file this ordinance and attached cooperative agreement.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Line Creek Meadows-Second Plat, a subdivision in Kansas City, Platte County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

 

Section 4. That the Aviation and Noise Easement executed by Real Properties Holding, Inc., for the purposes as therein set out, in, through, over and across the air-space above lands, of which lands the plat herein accepted is included, be and the same is hereby accepted and the original of said Aviation Easement is attached hereto and made a part hereof.

 

Section 5. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 23856 duly adopted on April 1, 1977, for public use for park purposes to-wit:

 

A tract of land in the Northwest Quarter of Section 9, Township 51, Range 33, Kansas City, Platte County, Missouri, being bounded and described as follows: Commencing at the southwest corner of said Northwest Quarter; thence South 89 29'01" East, along the south line of said Northwest Quarter, 851.62 feet; thence North 0 30'59" East, 661.46 feet to the true point of beginning of the tract to be herein described, said point being also the northeast corner of Line Creek Meadows-First Plat, a subdivision of land in Kansas City, Platte County, Missouri, said point being also a point on the west right of way line of Line Creek Parkway, as now established; thence North 74 57'02" West, along the north line of said Line Creek Meadows-First Plat, 130.43 feet; thence North 80 24'16" West, along said north line, 122.75 feet; thence North 87 19'08" West, along said north line, 70.31 feet; thence North 1 33'17" East, along said north line, 40.16 feet; thence North 27 57'20" West, along said north line, 40.01 feet; thence North 54 05'02" East, along said north line, 125.53 feet; thence North 6 02'45" West, along said north line, 140.50 feet; thence North 19 18'33" West along said north line, 118.75 feet; thence North 42 49'53" East, 148.92 feet; thence North 4 06'04" West, 222.12 feet; thence North 54 41'04" East, 173.73 feet; thence North 17 08'07" East, 128.40 feet; thence North 17 39'56" West, 153.48 feet; thence North 32 58'32" West, 123.04 feet; thence South 89 09'04" East, 289.51 feet; thence North 0 50'56" East, 110.00 feet; thence easterly, along a curve to the right, having an initial tangent bearing of South 89 09'04" East, a radius of 470.00 feet, an arc distance of 84.21 feet; thence South 78 53'07" East, 56.71 feet; thence easterly and southerly, along a curve to the right, tangent to the last described course, having a radius of 15.00 feet, an arc distance of 23.05 feet to a point on the aforementioned west right of way line of Line Creek Parkway, as now established; thence southerly, along said west line, on a curve to the left, having an initial tangent bearing of South 9 09'32" West, a radius of 1307.45 feet, an arc distance of 79.63 feet; thence South 5 40'09" West, 321.87 feet; thence southerly, along said west line, on a curve to the right, tangent to the last described course, having a radius of 1709.66 feet, an arc distance of 514.84 feet; thence South 22 55'23" West, along said west line, 275.00 feet; thence southerly, along said west line, on a curve to the left, tangent to the last described course, having a radius of 1396.00 feet, an arc distance of 191.81 feet to the true point of beginning.

 

Containing 10.91 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

 

Section 6. That the Director of Public Works is hereby authorized to execute a First Amendment to the Cooperative Agreement for Public Improvement for Street Lights and Landscaping, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference.

 

Section 7. That the City Clerk is hereby directed to file copies of this ordinance, together with the First Amendment to the Cooperative Agreement for Public Improvement for Street Lights and Landscaping attached hereto, in the Office of the Secretary of State of Missouri and in the Office of the Recorder of Deeds of Platte County, Missouri together with all other relevant documents.

 

Section 8. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
