Rezoning an area of approximately 20.2 acres generally located on the west side of Noland Road, approximately 1,000 feet north of Bannister Road from District RA to District R-1bb. (13393-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0650, rezoning an area of approximately approximately 20.2 acres generally located on the west side of Noland Road, approximately 1,000 feet north of Bannister Road from District RA (Agricultural) to District R-1bb (One-Family Dwellings, Low Density), said section to read as follows:

 

Section 80-11A0650. That an area legally described as:

 

Description per Title Commitment prepared by Stewart Title of Kansas City, No. 02040876 B, Dated September 26, 2002.

 

Tract I: All that part of Lot 36, lying west of Noland Road, UNITY RIDGE AND GARDENS, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract II: All that part of the Northwest Quarter of the Southeast Quarter of Section 27, Township 48, Range 32, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the Northeast Quarter of the Southeast Quarter of said Section 27; thence South on Section Line 40 rods, more or less, to the center of Little Blue Creek; thence in a Northwesterly direction with the meanderings of said creek to a point where the center of said creek intersects the center of county road at Iron Bridge (said point being 297 feet west of the East Line of said Quarter Quarter Section on center line of said road); thence in a Northeasterly direction from said point with the meanderings of said creek to the North line of said Quarter Quarter Section; thence East 6 rods, more or less to the place of beginning.

 

Tract III: All that part of Lot 35, UNITY RIDGE AND GARDENS, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning 556.1 feet East and 219 feet south of the Northwest corner the Southwest Quarter of Section 26, Township 48, Range 32; thence North 7655 East, 276 feet; thence South 115 West, 300.6 feet; thence North 4748 West, 354.4 feet to beginning.

 

Tract IV: All that part of the Southwest Quarter of Section 26, Township 48, Range 32, in Kansas City, Jackson County, Missouri, described as follows: Beginning 348.2 feet South of the Northwest corner of the Southwest Quarter of Section 26, Township 48, Range 32 in Kansas City, Jackson County, Missouri; thence North 7655 East 340 feet; thence South 1955 West, 227.7 feet; thence South 3940 West, 265 feet to center of Little Blue Creek; thence North 6030 West with center of said creek 94 feet to the West section line; thence North 302 feet to beginning.

 

Tract V: All that part of the Southwest Quarter of Section 26, Township 48, range 32, in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point 556.1 feet East and 219 feet South of the Northwest corner of the Southwest Quarter of Section 26, Township 48, Range 32, in Kansas City, Jackson County, said point being the intersection of the South line of the old oiled road; thence South 4748 East with the center of old road, 354.4 feet to the West line of Noland Street; thence South 115 West with the West line of Noland Street, 497.1 feet; thence North 8912 West, 337.0 feet to the center of Little Blue Creek; thence North 5604 West, with center of creek, 494.0 feet; thence North 3940 East, 265 feet; thence North 1955 East, 227.7 feet; thence North 7655 East, 231.0 feet to the point of beginning.

 

EXCEPT that part of Tracts II, IV, and V as described as follows:

 

All that part of the Northeast Quarter of the Southeast Quarter of Section 27, Township 48, Range 32, also, all that part of the Northwest Quarter of the Southwest Quarter of Section 26, Township 48, Range 32 in Kansas City, Jackson County, Missouri, described as follows: Beginning at the Northeast corner of said Northeast Quarter of the Southeast Quarter of Said Section 27; thence South 354533 West, a distance of 405.95 feet; thence South 20733 West, a distance of 65.38 feet; thence South 365627 East, a distance of 128.57 feet; thence South 632657 East a distance of 229.00 feet; thence South 600805 East a distance of 499.07 feet; thence South 164350 East a distance of 87 feet more or less to the Grantors South property line; thence North 863511 West along said South property Line a distance of 90 feet more or less to the center line of the Little Blue River; thence Northwesterly, Northerly, Northeasterly direction with the meanderings of said River to the North line of the Northeast Quarter of the Southeast Quarter of Section 27; thence South 861829 East along said North line a distance of 99 feet more or less to the point of beginning.

All that part of the W1/2 of Section 26 and the SW 1/4 of Section 27, all in Township 48 North, Range 32 West, Kansas City, Jackson County, Missouri, described as follows: Beginning at the W 1/4 corner of said Section 26; thence N 022744 E along the West line of said Section 26, a distance of 154.62 feet to the Southwest Corner of SILVERTOOTH FAHEY FARMS, a subdivision in said City, County, and State; thence N 864345 E along the South line of said subdivision, a distance of 814.78 feet to a point on the West right of way line of Noland Road as it now exists; thence S 033422 W along said west right of way line, a distance of 1180.13 feet to a point on the north line of a tract of land conveyed by Document #1999-I-0071009 (1-3); thence N 804159 W (N 8012 W-Deed), a distance of 266.81 feet; thence the following six (6) courses along the boundary line of that part conveyed to the Jackson County Parks Department; (1) thence N 205208 W (N 164350 W-Deed), a distance of 89.87 feet (87.00 feet-Deed); (2) thence N 600956 W (N 600805 W-Deed), a distance of 498.98 feet (499.07 feet-Deed); (3) thence N633746 W (N 632657 W-Deed), a distance of 230.43 feet (229.00 feet-Deed); (4) thence N 363951 W (N 365627 W-Deed), a distance of 128.09 feet (128.57 feet-Deed); (5) thence N 020412 E (N 020733 E-Deed), a distance of 65.36 feet (65.38 feet-Deed); (6) thence N 354320 E (N 354533 E-Deed), a distance of 406.10 feet (405.95 feet-Deed) to the Point of Beginning, containing 20.184 acres, more or less, except 1.905 acres in existing right of way for Vale Road, Boggs Hollow Road and Unity Central Highway, all being subject to easements, rights of way, and restrictions of record.

 

is hereby rezoned from District RA (Agricultural) to District R-1bb (One-Family Dwellings, Low Density), all as shown outlined on a map marked Section 80-11A0650, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
