Amending an amendment to a
previously approved development plan District R-5-p on approximately a 6 acre
tract of land generally located at the southeast corner of N.E. 80th Street and
N. Spruce Street. (12542-P-7)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
an amendment to a previously approved development plan in District R-5-p (High
Apartments Limited District) on approximately a 6 acre tract of land
generally located at the southeast corner of N.E. 80th Street and N. Spruce Street, and more specifically described as follows:
All that part of the
Northwest Quarter of Section 17, Township 51 North, Range 32 West, in the City
of Kansas City, Clay County, Missouri, being more particularly described as
follows: Commencing at the Northwest Corner of the Northwest Quarter of said
Section 7; thence South 885757 East, along the North line of the Northwest
Quarter of said Section 17, a distance of 459.00 feet; thence South 004018
East, a distance of 30.00 feet to the intersection of the South right-of-way
line of NE 80th Street, as now established and recorded in the Office of the
Register of Deeds, Clay County, Missouri, in Book 508 at Page 75 and the East
right-of-way line of North Spruce Avenue, as now established and recorded in
the Office of the Register of Deeds, Clay County, Missouri, in Book 508 at Page
75, said point also being the Point of Beginning of this description; thence
South 885757 East, along said South right-of-way line of NE 80th Street,
30.00 feet South of and parallel with the North line of the Northwest Quarter
of said Section 17, a distance of 556.56 feet; thence South 000338 West, a
distance of 138.88 feet; thence South 573825 East, a distance of 124.03
feet; thence South 895521 East, a distance of 452.91 feet; thence North
773023 East, a distance of 82.49 feet; thence South 561742 West, a
distance of 424.07 feet; thence North 894443 West, a distance of 297.02
feet; thence North 002450 East, a distance of 136.19 feet; thence North
885757 West, a distance of 549.16 feet to a point on said East right-of-way
line of North Spruce Avenue; thence North 004015 East, along said East
right-of-way line of North Spruce Avenue, a distance of 286.01 feet to the
Point of Beginning, and containing 6.0294 Acres, more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a storm drainage study for the entire
development to the City Engineer's Office for approval when the final plat is
submitted and that the developer make any necessary improvements as required by
the City Engineer's Office.
3.
That the developer submit plans for grading and siltation and erosion
control to the City Engineer's Office for approval prior to beginning any
construction activities.
4.
That the developer secure a land disturbance permit from the Department
of Public Works prior to beginning any construction, grading, clearing or
grubbing activities, if the disturbed area exceeds one acre.
5.
That the developer dedicate 60 feet of right of way from centerline on
the east half of N. Spruce and for future Maplewoods Parkway.
6.
That the developer install hard surface roads and provide for fire
protection as required by the Fire Department prior to construction beyond
foundations.
7.
That the developer extend sanitary sewers as required by the Department
of Public Works.
8.
That the developer extend water mains as required by the Water Services
Department.
9.
That the developer dedicate 30 feet of right of way from centerline on
the south side of N.E. 80th Street and as necessary for the
roundabout as required by the Department of Public Works.
10.
That the developer improve the south half of N.E. 80th Street
to collector street standards including construction of curb, gutter, sidewalks
and installation of streetlights, as required by the Department of Public
Works.
11.
That the developer improve the east half of N. Spruce Avenue to
collector street standards, including curb, gutter, sidewalks and installation
of streetlights, as required by the Department of Public Works and the Parks
and Recreation Department and/or in accordance with the most current adopted
revisions to the Major Street Plan for N. Spruce Avenue.
12.
That the developer secure a floodplain certificate from the Department
of Codes Administration prior to beginning any construction activities within
the floodplain.
13.
That the developer show the limits of the floodplain on the final plat
as required by the Department of Public Works.
14.
That the developer submit a final plan to the City Plan Commission for
approval, including plans for building materials and elevations, signage,
grading, lighting (including a photometric study showing 0 footcandles at the
property lines) and landscaping.
15.
That the developer obtain any required approval from the Board of Zoning
Adjustment for the offices and signage.
A copy of said amendment is on
file in the office of the City Clerk with this ordinance, which is attached
hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
