ORDINANCE NO. 180270

 

Authorizing sale of 2.99 acre tract generally located at 2025 Tracy, and lot immediately south, for the consideration of $127,000.00, which tract was removed from the City’s park system pursuant to a special election held on November 7, 2017; and directing the City Clerk to record this Ordinance with the Office of the Recorder of Deeds of Jackson County, Missouri.

 

  WHEREAS, as evidenced by Resolution No. 30876, the Board of Parks and Recreation Commissioners determined that the 2.99 acre tract generally located at E. 21st Street and Tracy Avenue, was no longer necessary or appropriate for park, parkway, or boulevard use, and that such property could be removed from the park system by a vote of the people; and

 

WHEREAS, on August 10, 2017, the City Council passed Ordinance No. 170564 which authorized an election to be held to approve the removal of such 2.99 acre tract by a vote of the people, and such election was held November 7, 2017, the outcome of which supported the removal of the tract from the park system; and

 

WHEREAS, such favorable vote allowed the City to dispose of the property as surplus property; and

 

WHEREAS, the City solicited bids for the purchase of the surplus property, disclosed the zoning classification of the area as being split with the northerly portion being M1-5, and the southerly portion being R-1.5, and that the proposed use of any bidder would be a factor to be considered in the decision of which bid to select; and

 

WHEREAS, the City received two bids for the surplus property both of which were in excess of the advertised minimum bid of $126,000.00, but with substantially different proposed uses; and

 

WHEREAS, the 2.99 acre tract is within the Greater Downtown Area Plan, and such Plan was adopted by the City Council by Committee Substitute for Ordinance No. 100049 passed March 11, 2010, as a guide for future development and public investment, and such Plan designates a recommended land use for this tract as Downtown Mixed Use as to the northerly portion (which accommodates office, commercial, light industrial, manufacturing, public/institutional, residential uses at a lower density) and Downtown Residential as to the southerly portion (which accommodates residential development and small commercial on lower floors with residential above); and

 

WHEREAS, the easterly 150 feet of the 2.99 acre tract is subject to restricted uses due to its proximity to Paseo Boulevard, being a part of the park system, particularly, but not limited to, that portion is currently zoned M1-5; and

 

WHEREAS, District Row, LLC, offered $127,000.00 for the surplus property for the purpose of demolishing the existing structure, and constructing thirty-five townhomes on that site, collaboratively with the mixed use development to the south that includes the renovation of the historic Gillis Building operated by the Western Baptist Bible College; the proposed design of such townhomes included with their bid will complement the nearby Beacon Hills development; and

 

WHEREAS, of the two bids received, only the proposed use by District Row, LLC, could be pursued without a rezoning of the surplus property or seeking special use permits; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of the Parks and Recreation Department is authorized: a) to execute a Special Warranty Deed conveying the below described City owned parcel to District Row, LLC, with the final legal description being determined by survey, if any, if different than that set out below, in consideration for the payment of $127,000.00, b) to execute any and all other real estate and closing documents necessary, and c) to take such further actions as are required to carry out the intent of this ordinance to convey the 2.99 acre tract to District Row, LLC, for the intended demolition of the existing structure, and the construction of thirty-five townhomes or other residential purposes. Such 2.99 acre tract, in the vicinity of E. 21st Street and Tracy Avenue, Kansas City, Jackson County, Missouri, is more specifically described as:

 

All that part of Blocks P, Q, T and U, Lockridge’s Addition, a subdivision in the SW 1/4 of Section 9, Township 49N, Range 33W of the 5th P.M. in Kansas City, Jackson County, Missouri described as follows: Beginning at a point on the West line the of said Block Q, said point being 52.00 feet south of the Northwest corner of said Block Q; thence North 2 degrees 13 minutes 23 seconds East, along said West line and the West line of said Block P, 243.00 feet to the Southwest corner of Berkowitz Addition, a subdivision; thence South 87 degrees 29 minutes 01 seconds East, along the South line of said Berkowitz Addition and its extension, 535.64 feet to the Northeast corner of said Block U; thence South 2 degrees 10 minutes 08 seconds West, along the East line of said Block U and Block T, 243.00 feet to a point 52.00 feet south of the Northeast corner of said Block T; thence North 87 degrees 29 minutes 01 seconds West, along a line parallel with and 52.00 feet south of the North line of said Block T and Block Q, 535.87 feet to the point of beginning, except that part in alleys and roads. Containing 2.99 acres, more or less.

 

Section 2. That the City Clerk is directed to record with the Jackson County, Missouri Recorder of Deeds a certified copy of this ordinance.
