ORDINANCE NO. 100447

 

Amending Chapter 78 of the Code of Ordinances of Kansas City, entitled “Water”, by repealing Sections 78-2(a) and 78-15.1(a) and enacting in lieu thereof two new subsections of like number and subject matter that allows accounts to be in the name of either the owner of the occupant.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That Chapter 78 of the Code of Ordinances of Kansas City, Missouri, entitled “Water”, is hereby amended by repealing Sections 78-2(a) and 78-15.1(a) and enacting in lieu thereof new subsections of like subject matter, to read as follows:

Sec. 78-2.  Water service generally.

  (a) Availability. Water may be taken by any applicant for a license to use water, upon approval by the water services department, who shall first and at all times thereafter comply with the rules and regulations of the water services department and with all ordinances of the city relating in any way to the purchase of water and to facilities and conditions related to its use, and who shall pay for such water according to the established rates.

Sec. 78-15.1. Property owner liability for water and sewer services; delinquent

charges; liens.

(a)   Water and sanitary sewer services shall be deemed to be furnished to both the occupant and the owner of the premises receiving either or both of such services. Any delinquent charges shall be chargeable against any deposit held by the water services department for service to such premise.
