ORDINANCE NO. 041127

 

Approving a first modification to the general development plan for the Oak Pointe Redevelopment Planning Area for an area of approximately 8.4 acres generally bounded by 38th Street on the north, 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west, by deleting certain tracts of land from the Planning Area.

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or cause to be prepared a General Development Plan for the Oak Pointe Redevelopment Planning Area (generally bounded by 38th Street on the north, 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west) and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

WHEREAS, the City Plan Commission reviewed and recommended approval of the finding of blight and of the General Development Plan for the Oak Pointe Redevelopment Planning Area on March 16, 2004, as evidenced by its resolution and has found said plan to be in conformance with the general plan for the development of the community as a whole, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; and

 

WHEREAS, the Council determined that ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are necessary to attract developers in the area;

 

WHEREAS, Ordinance No. 040329 approved a general development plan for the Oak Pointe Redevelopment Planning Area; declared the area described therein to be a blighted, insanitary or undeveloped industrial area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; and approved ad valorem tax benefits pursuant to Section 100.570, RSMo; and

 

WHEREAS, the Council desires to modify the general development plan for the Oak Pointe Redevelopment Planning Area; NOW, THEREFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the General Development Plan for the Oak Pointe Redevelopment Planning Area being that area of approximately 8.4 acres generally bounded by 38th Street on the north, 39th Street on the south, Elmwood Avenue on the east and Kensington Avenue on the west, is hereby modified to delete from the Planning Area the following described tracts of land:

 

4408 E. 39th Street: Allen Robert Addition, Lots 1-15 and west one-half of vacated Cypress Avenue and west and adjacent Lots 1-4 and 9, a subdivision in Kansas City, Jackson County, Missouri.

 

3819 Kensington Avenue: Thomas B. Thomas Estate Commissioners Plat, south 76 feet of north 317.04 feet of east 304.35 feet of Lot 12, a subdivision in Kansas City, Jackson County, Missouri.


Section 2. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

 

Section 3. That said First Modification to the General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.
