ORDINANCE NO. 080250

Authorizing the Director of Public Works to enter into an agreement with The Port Authority of Kansas City, Missouri and IOC-Kansas City, Inc, for the purposes of ensuring that the Missouri Highways and Transportation Commission (MHTC) is granted all necessary right-of-way for the relocation of East Front Street and the construction of additional improvements in conjunction with the new Paseo Bridge project; consenting to the amendment of the lease agreement between City and Port Authority to include the excess right-of-way lying east and west of the new bridge as a result of the relocation of East Front Street and construction of the new Paseo Bridge; and consenting to the amendment of IOC-Kansas City, Incs sublease to include said excess right-of-way lying east of the new bridge; and recognizing an emergency.

  WHEREAS, MHTC has executed a contract for the purpose of making improvements to Interstate Routes 29 and 35 (I-29/35) in Jackson and Clay Counties, Missouri, including a new Paseo Bridge over the Missouri River (the kcICON Project); and

WHEREAS, in conjunction with the kcICON Project, MHTC will be relocating East Front Street from its present location to an east-west alignment lying immediately south of the IOC-KC casino and traveling under the new Paseo Bridge; and

WHEREAS, the plans for the kcICON Project include the installation of traffic signals, curb cuts and turn lanes for vehicles traveling east and west on relocated East Front Street in a manner that will allow safe and convenient access to the IOC-KC casino; and

WHEREAS, following the relocation, portions of presently existing East Front Street will be vacated by City; and

WHEREAS, the inclusion of the vacated portions of existing East Front Street within the property leased by City to Port Authority, and the inclusion of the vacated portion of existing East Front Street bisecting the IOC-KC casino site within the property subleased by Port Authority to IOC-KC is proper and in the publics best interest as it will relieve the City of the costs of maintaining such vacated portions of East Front Street; and

WHEREAS, cooperation between the City, Port Authority and IOC-KC is essential to ensuring that MHTC acquires the right-of-way needed for the kcICON Project and the relocation of East Front Street and related improvements thereto; and

WHEREAS, time is of the essence as MHTC must acquire the needed right-of-way and consent of the parties so that it can cause its contractor to proceed with final design and construction of the kcICON Project; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the Director of Public Works is authorized to enter into an agreement with The Port Authority of Kansas City, Missouri and IOC-Kansas City, Inc. for the purposes set forth herein. The agreement shall be in a form substantially similar to that attached hereto.

Section 2. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it relates to the design, repair, maintenance or construction of a public improvement to be paid in part by State funds, and shall take effect in accordance with that section.
