ORDINANCE NO. 050650

 

Rezoning an area of approximately 34 acres generally located at N.E. 104th Terrace and N.E. 105th Terrace, east of N. Marsh Avenue from Districts R-2b and R-3 to District R-1a, and approving a development plan for the same. (6056-P-16)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0627, rezoning an area of approximately 34 acres generally located at N.E. 104th Terrace and N.E. 105th Terrace, east of N. Marsh Avenue from Districts R-2b (Two-Family Dwellings) and R-3 (Low Density, Low Apartments) to District R-1a, (One-Family Dwellings, Medium Density), said section to read as follows:

 

Section 80-11A0627. That an area legally described as:

 

A tract of land in the Southeast Quarter of Section 27, Township 52N, Range 32W in Kansas City, Clay County, Missouri, more particularly described as follows: Commencing at the Southeast corner of the Southeast Quarter; thence North 89 degrees, 31 minutes, 32 seconds West, along the South line of the Southeast Quarter, 550.00 feet, to the point of beginning; thence continuing North 89 degrees, 31 minutes, 32 seconds West, along the South line, 1445.20 feet, to the Southwest corner of the East Half of the West Half of the Southeast Quarter; thence North 00 degrees, 28 minutes, 41 seconds East, along the West line of the East Half of the West Half, 1141.69 feet; thence South 89 degrees, 33 minutes, 18 seconds East, 555.00 feet; thence South 73 degrees, 06 minutes, 00 seconds East, 823.60 feet; thence South 04 degrees, 38 minutes, 29 seconds West, 370.14 feet; thence South 42 degrees, 56 minutes, 50 seconds East, 181.50 feet; thence South 00 degrees, 09 minutes, 18 seconds West, 408.11 feet, to the point of beginning, containing 34.07 acres, more or less.

is hereby rezoned from Districts R-2b (Two-Family Dwellings) and R-3 (Low Density, Low Apartments) to District R-1a, (One-Family Dwellings, Medium Density), all as shown outlined on a map marked Section 80-11A0627, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
