RESOLUTION NO. 050187

 

Expressing support for the Kansas City Police Employees Retirement Systems 2005 Legislative Package.

 

WHEREAS, pursuant to Committee Substitute for Resolution No. 041209 the City established its positions on matters that may come before the Missouri General Assembly during its 2005 Session; and

 

WHEREAS, the City desires to establish an additional general statement of its position on a matter that may become the subject of or be affected by proposed legislation during the 2005 Session; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the City Council of Kansas City hereby adopts the following position on a matter that may come before the Missouri General Assembly during its 2005 Session:

 

The City supports the Kansas City Police Employees Retirement Systems 2005 Legislative Package. Such Legislative Package contains recommended amendments to State Law effecting both police and civilian employees plans. The Legislative Package recommends the following:

 

a.       Adding a definition of consultant;

 

b.      Deleting the inference that pension benefits are tax exempt;

 

c.       Improving the definition of an eligible spouse;

 

d.      Improving the definition of the cost of living adjustments;

 

e.       Deleting the reference to medical care costs or hospitalization for supplemental benefits;

 

f.        Allowing surviving spouses an opportunity to vote within the plan;

 

g.       Requiring members to be vested prior to eligibility in the retirement system;

 

h.       Prohibiting members from receiving pension benefits if they have been convicted of a felony prior to retirement;

 

i.         Tying creditable service to the time when a civilian plan member received compensation;

 

j.        Allowing a civilian plan member to purchase prior service in the plan;

k.      Delete the provision that the office of board secretary and treasurer shall not be the same person;

 

l.         Delete provision allowing refund contributions on demand;

 

m.     Maintain childs benefits at fifty dollars per month regardless of whether the benefit is received by a child or a child in lieu of a surviving spouse;

 

n.       Delete option for a future retirement benefit after ten years of service if a member is terminated by the police board;

 

o.      Delete board of commissioners approval to purchase prior service; and

 

p.      Allow members to receive credit while on leave of duty with the Armed Forces.
