ORDINANCE NO. 051379

 

Approving an amendment to a previously approved preliminary plan in District CP-2 on approximately an 11.4 acre tract of land generally located on the north side of N.E. Cookingham Drive between N. Ash Avenue and N. Cedar Avenue. (6158-CP-20)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 11.4 acre tract of land generally located on the north side of N.E. Cookingham Drive between N. Ash Avenue and N. Cedar Avenue, and more specifically described as follows:

 

A tract of land in the Southwest Quarter of Section 36, Township 52 North, Range 32 West, in Kansas City, Clay County, Missouri including Lot 1, Highland Business Park Sonic Drive-In, described as follows: Commencing at the Northwest corner of said Southwest Quarter; thence South 05203 West along the West line of said Southwest Quarter, 1297.81 feet; thence South 890757 East, 411.94 feet to the Southwest corner of Lot 1, Amber Meadows First Plat, a subdivision of land in said Kansas City, said point also being on the Easterly right-of-way line of N. Cedar Avenue, as now established by said subdivision plat, and the True Point of Beginning of the tract of land to be herein described; thence South 853419 East along the Southerly line of said Amber Meadows First Plat, 332.88 feet; thence North 895658 East along said Southerly line, 250.00 feet; thence South 374653 East along said Southerly line, 352.17 feet to a point on the Westerly right-of-way line of N Ash Avenue, as established by said Amber Meadows First Plat; thence Southerly along said Westerly right-of-way line, along a curve to the left having an initial tangent bearing of South 382005 West with a radius of 830.00 feet, a central angle of 121126 and an arc distance of 176.59 feet; thence South 260839 West along said Westerly right-of-way line, 52.01 feet; thence Southwesterly along said Westerly right-of-way line along a curve to the right, being tangent to the last described course, with a radius of 800.00 feet, a central angle of 90407 and an arc distance of 126.62 feet; thence Southwesterly along said Westerly right-of-way line along a curve to the left, having a common tangent with the last described course, with a radius of 800.00 feet, a central angle of 90407, and an arc distance of 126.62 feet; thence South 260839 West along said Westerly right-of-way line, 140.04 feet; thence Westerly along said Westerly right-of-way line along a curve to the right, being tangent to the last described course with a radius of 15.00 feet, a central angle of 900000, and an arc distance of 23.56 feet to the Northerly right-of-way line of Missouri Route 291, as now established by said Amber Meadows First Plat; thence North 635121 West along said Northerly right-of-way line, 381.44 feet; thence Northwesterly along said Northerly right-of-way line along a curve to the left, having an initial tangent bearing of North 634755 West, with a radius of 7699.44 feet, a central angle of 12442 and an arc distance of 189.70 feet; thence Northerly along said Northerly right-of-way line along a curve to the right being tangent to the last described course with a radius of 40.00, a central angle of 891951 and an arc distance of 62.36 feet; thence North 240717 East along the Easterly right-of-way line of aforesaid N. Cedar Avenue 38.57 feet; thence Northerly along said Easterly right-of-way line along a curve to the left being tangent to the last described course with radius of 550.00 feet, a central angle of 241016 and an arc distance of 232.03 feet; thence North 00302 West along said Easterly right-of-way line, 286.90 feet to the Point of Beginning. Containing 11.426 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit new or update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by Development Services.

 

3. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

4. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by the Department of Public Works, prior to recording the next plat.

 

5. That any relocated streetlights be integrated into the existing street light system as required by Development Services and the Missouri Department of Transportation along State frontages.

 

6. That the developer obtain a permit from the Missouri Department of Transportation (MODOT) prior to working in State highway right-of-way.

 

7. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

8. That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

9. That the developer extend sanitary sewers and provide a storm water conveyance system to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

10. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

11. That the developer submit a final plan to the City Plan Commission for approval, showing grading, landscaping, berming and screening, showing a 4 foot berm with conifers, the berming will extend behind each of the parking areas adjacent to the single-family lots to the north, building elevations and a photometric study showing zero footcandles at the property line.

 

12. That the walkway along the north side of Missouri Route 291 from N. Cedar Avenue on the west to the east side of the proposed Quik Trip site on the east, be constructed with the next requested building permit issued within the Highland Park Business Center project.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
