COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050886

 

Approving the preliminary plat of Southmoreland Place Condominium on a .15 acre tract of land generally located on the east side of Walnut Street, halfway between 41st and 42nd Streets (4121-4123 Walnut Street). (SD 1184)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Southmoreland Place Condominium on a .15 acre tract of land generally located on the east side of Walnut Street, halfway between 41st and 42nd Streets (4121-4123 Walnut Street), and more specifically described as follows:

 

All that part of Lots 61 and 62, GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning 133.65 feet West of the East line and 53.00 feet South of North line of said Lot 62; thence S240'31"W and parallel with East line of said Lots 61 and 62; a distance of 50.00 feet; thence N8727'35"W and parallel with the North line of said Lot 62, 38.00 feet; thence N240'31"E and parallel with the East line of said Lot 62, 11.00 feet; thence N8727'35"W and parallel with the North line of said Lot 62 for 95.91 feet to the East line of Walnut Street (60'r/w); thence N234'39"E along the East line of Walnut Street, 46.00 feet; thence S8727'35"E and parallel with the North line of said Lot 62, 95.65 feet; thence S240'31"W and parallel with the East line of said Lot 62, 7.00 feet; thence S8727'35"E and parallel with the North line of said Lot 62 for 38.34 feet to beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by Development Services in accordance with Chapters 56 and 64 Code of Ordinances, prior to recording of the plat.

 

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas and private open space tracts.

 

4.                  That the developer receive approval of the Board of Zoning Adjustment for any necessary variances.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
